Both suggestions were greeted with acceptance from the Board. Gary will revise his PDP drawings to show the excess outflow from our "on -site" detention, flowing underground and discharging into the existing detention on the Sunstone property. Gary's PDP work will include the required easements, etc. that will record all of this when we file the final development plan (FDP). Similarly, Gary will describe the area we intend to use for your trash enclosure, and likewise, he will need to describe an easement (because we are going to build your trash enclosure on their property) for your access, etc. The Board did request that we provide some sort of legal language, that will protect them from liability if something happens on their property (ie. an employee of Aspen Dental slipping on ice while taking out the trash, AND, some language that will give them the right to have the trash removed if for some reason, you decide not to do it). This is all very standard stuff and I believe Jim Martell can draft something up without much difficulty for their review. This will need to be a part of the Final Submittal, so we will get to work on these items when we get the PDP comments back from the City. We are scheduled to make the PDP submittal on December 23, and we will copy you on everything as you have requested. We should receive comments from the city in 3 weeks.
