Facility ODP Application
Dear Barb,
Thank you for your emails voicing your concerns regarding the PSD project located at the
northwest corner of East Prospect Rd. and County Road 5. The City is currently reviewing the
project as an Overall Development Plan (ODP). My responsibilities for reviewing an ODP
application are limited to ensuring that all future development on the property complies with
Section 3.4.1 — Natural Habitat and Features, of the Land Use Code (LUC). You can access the

During the review of the project plans, I conducted two site investigations to become familiar with
the ecological character of the property. Based upon my site visits and review of available
literature, I have determined that the site, except the Cache La Poudre Reservoir Inlet Canal, is
devoid of any ecological character. The property has been used for crop production over the
years and remains an empty piece of property. Thus, the canal is the only feature on the site that
will be protected under Section 3.4.1(E) of the LUC.
In your most recent email, you formally requested that the City conduct an environmental study of
the site due to numerous environmental concerns. Under Section 3.4.1(D), the Director may
require an Ecological Characterization Study (ECS) be prepared for the site under review. If an
ECS would be required, the applicant would be responsible for preparing said study, not the City.
As stated in the previous paragraph, with the site predominantly devoid of any ecological
character, the City will not be required an ECS be prepared as part of any development review.
If you feel that there are compelling reasons to have the City require an ECS for the site, you will
need to provide any pertinent information as required in Section 3.4.1(D). If you wish to pursue
your concerns in such a manner, I can provide you with the name of several firms that routinely
conduct ECS for review by my office.
