SUMMARY OF CONCLUSIONS
A. The Larimer Center for Mental Health Major Amendment is subject to administrative
review and the requirements of the Land Use Code (LUC).
B. The Larimer Center for Mental Health Major Amendment complies with all applicable
district standards of Section 4 of the Land Use Code, (C-C) Community Commercial
zone district.
C. The Larimer Center for Mental Health Major Amendment complies with all applicable
General Development Standards contained in Article 3 of the Land Use Code
DECISION
The Larimer Center for Mental Health Major Amendment, #2-09 is hereby approved by the
Hearing Officer without condition.

FACTS AND FINDINGS
Site Context/Background Information
The surrounding zoning and land use are as follows:
N: C-C; Vacant
S: FA-1 County — Existing subdivision - single family detached homes
E: C; Existing Auto and Truck Dealership
W: C-C; Vacant
The site was developed as a place of worship in Larimer County (Dayspring Christian
Church). It was annexed as part of the larger Skyview Ltd. Annexation (42.74 acres) in
1989. As such, it preceded the Southwest Annexation. The subdivision to the south,
Skyview Acres, is part of Phase Three of the Southwest Annexation and scheduled to be
annexed in 2010.
2. Compliance with Article 4 and the CC — Community Commercial Zoning District
Standards:
The Project Development Plan complies with all applicable requirements of Article 4 and
the CC Zoning District. The two proposed land uses, General Office and Clubs and
Lodges, are permitted in the C-C subject to Administrative Review.The Staff Report
summarizes the Major Amendments compliance with these specific standards and no
specific evidence was presented to contradict the statements and conclusion of the staff
report concerning compliance with Article 4 or the CC District Standards.
3. Compliance with Article 3 of the Land Use Code — General Development Standards
The Project Development Plan complies with all applicable requirements of Article 3,
and no evidence was presented to contradict the statements and conclusion of the staff
report concerning compliance or to other refute the compliance with Article 3.

NOTICE OF PUBLIC HEARING: Evidence presented to the Hearing Officer established no
controversy or facts to refute that the hearing was properly
posted, legal notices mailed and notice published.
PUBLIC HEARING
The Hearing Officer, presiding pursuant to the Fort Collins Land Use Code, opened the hearing
at approximately 6:00 p.m. on April 7, 2009 in Conference Rooms A & B, 281 N. College
Avenue, Fort Collins, Colorado.
HEARING TESTIMONY, WRITTEN COMMENTS AND OTHER EVIDENCE:
The Hearing Officer accepted during the hearing the following evidence: (1) Planning
Department Staff Report; (2) application, plans; maps and other supporting documents submitted
by the applicant and the applicant's representatives to the City of Fort Collins; and (3) a tape
recording of the public hearing. The LUC, the City's Comprehensive Plan (City Plan), and the
formally promulgated policies of the City are all considered part of the evidence considered by
the Hearing Officer.

PROJECT DESCRIPTION:
This is a request to convert an existing church at 125 West Crestridge Drive into an office and
clubhouse for a private non-profit corporation. The clubhouse offers employment training
services, educational services, and help with socialization and wellness skills for approximately
20 to 40 clients served by five employees. In addition, there would be offices for approximately
20 - 40 other Larimer Center for Mental Health employees. No changes are proposed to the
building footprints, building heights, or the site plan as a result of the Major Amendment.
