The Initiating Resolution for the Eagle View Third Annexation was considered by City Council on December 2, 2008 and adopted. ANALYSIS: The requested zoning for this annexation is the RUL-Rural Lands Zoning District. The RUL District is for privately owned lands that are planned as a rural edge to the community. Rural lands include but are not limited to community separators, clustered residential development, large lot residential, natural area buffers and corridors, and other open lands of similar character and purpose. The City's adopted Structure Plan, a part of the Comprehensive Plan, indicates that the RUL-Rural Lands District is appropriate for this location. FINDINGS: In evaluating the proposal for the annexation and zoning of the Eagle View Third Annexation, staff makes the following findings of fact: 1. The annexation is consistent with the policies and agreements between Larimer County and the City of Fort Collins contained in the Intergovernmental Agreement. 2. The area meets the eligibility requirements included in State law to qualify for a voluntary annexation to the City of Fort Collins. 3. The requested Zone District, RUL-Rural lands, in conformance with the City's Comprehensive Plan and City Structure Plan Map. 4. On December 2, 2008, the City Council adopted a resolution determining the annexation process for this property that includes a public hearing regarding the readings of the Ordinances annexing and zoning the area. STAFF RECOMMENDATION: Staff recommends approval of the annexation and the requested zoning of the RUL-Rural Lands, District. ATTACHMENTS: 1. Eagle View Third Annexation Location map 2. Proposed Zoning map Eagle View Third Annexation, # 38-08 December 11, 2008 Planning and Zoning Hearing Page 2 between Strauss Cabin Road and Interstate-25; and Interstate-25 from Kechter Road to Harmony Road. On October 29, 2008, FCCLC filed an Amended Petition with the City Clerk making certain changes to the property to be annexed deleting the Kechter Road and Strauss Cabin Road portions. On November 21, 2008, the Petitioners (Dale and Terri Brown) submitted an Annexation Petition for the Eagle View Third Annexation. The "L" shaped Eagle View Third Annexation is a request to re -annex the portions of Kechter Road and Strauss Cabin Road which were disconnected on October 14, 2008, as well as other portions of those roads. Thus, the annexation mainly includes road rights -of -way including about'/4 mile of the right -of way of Kechter Road, from its intersection with Strauss Cabin Road to a point about'/4 mile west of 1-25, and about % mile of the right -of way of Strauss Cabin Road, from its intersection with Kechter Road to a point about'/ mile south of Harmony Road. The total size of the annexation is 5.9 acres with about .16 acres owned by the Petitioners whichis located on the south side of Kechter Road and included in the annexation request. The existing land uses and zoning of surrounding properties are as follows • North of Kechter Road and East of Strauss Cabin Road: o County - FA-1 Farming, mostly undeveloped, but includes the 4-lot Buderus Minor Residential Development (MRD) containing a couple of single-family homes on large lots near the intersection of Kechter and Strauss Cabin Roads. • South of Kechter Road and east of Strauss Cabin Road: o County FA-1 Farming, the City -owned Eagle View Natural Area (currently in the process of being annexed); and the Brown Minor Land Division (MILD) containing a single-family home (the Petitioner's residence) • West of Strauss Cabin Road and North of Kechter Road: o City LMN, Low Density Mixed Use Neighborhood, Sunrise Ridge 2nd Subdivision residential development; and County FA-1 Farming, four 5-acre lots with single-family homes Compliance with Existing Policies and State Law The area of the Eagle View Third Annexation is totally located within the Fort Collins Growth Management Area (GMA). According to policies and agreements between the City of Fort Collins and Larimer County contained in the Intergovernmental Agreement for the Fort Collins Growth Management Area, the City will agree to consider annexation of property in the GMA when the property is eligible for annexation according to State law. County Road 36 Fort Collins, CO 80525 OWNERS: Same PROJECT DESCRIPTION: This is a 100% voluntary request to annex approximately 5.9 acres known as the Eagle View Third Annexation and place the area into the RUL-Rural Lands Zoning District. RECOMMENDATION: Staff recommends approval of the annexation and recommends that the Eagle View Third Annexation be placed into the RUL-Rural Lands Zoning District. EXECUTIVE SUMMARY: This is a 100% voluntary request to annex approximately 5.9 acres known as the Eagle View Third Annexation and place the area into the RUL-Rural Lands Zoning District. The. annexation is in conformance with the State of Colorado Revised Statutes as they relate to annexations, the City of Fort Collins Comprehensive Plan, the Larimer County and City of Fort Collins Intergovernmental Agreement, the City of Fort Collins Land Use Code, and the Harmony Corridor Plan and the Fossil Creek Reservoir Area Plan. BACKGROUND: Applicants and Property Owners: Dale and Terri Brown October 14, 2008, the City Council transferred ownership of a portion of the Arapaho Bend Natural Area ("Natural Area") located north of Harmony Road and west of 1-25 to the Fort Collins Capital Leasing Corporation ("FCCLC"). The Council then received from FCCLC an application to disconnect from the City the portions, of the Natural Area owned by the FCCLC. Council then adopted Emergency Ordinance No. 130, 2008, which authorized the disconnection of portions of the Natural Area owned FCCLC, as well as portions of Harmony Road, Strauss Cabin Road, and Kechter Road. Later that .same day, an Annexation Petition was filed by FCCLC to re -annex the Natural Area, together with Harmony Road; Strauss Cabin Road between Harmony and Kechter Roads; Kechter Road
