W/HABITABLE SPACE - PDP - 10-07 - REPORTS - MODIFICATION REQUESTApplication for Modification of Standards Side and Rear Setbacks This application is a request to allow a modification of setbacks along the rear and side lot lines at 216 South Grant Avenue, Fort Collins, in order to construct an accessory building with habitable space. Section 4.7(E)3 states that the "Minimum rear yard setback shall be five (5) feet from existing alleys and fifteen (15) feet in all other conditions." Section 4.7(E)4 states that "Minimum side yard width shall be five (5) feet for all interior side yards." We are requesting that the setback be reduced to 2 feet and 9 inches on the north side and along the alley in order to save existing trees. This request is in accordance with the City's Modification of Standards, Section 2.8.2(H)3 which addresses existing physical conditions and Section 2.8.2(H)4 which addresses nominal and non -consequential modifications. Approval of this modification request will allow us to build a usable structure and retain established landscaping. The block wall along the alley serves as an attractive buffer to the alley and also mitigates the reduced setback. We have spoken with our neighbor to the north and they have no concerns with the reduced setback and are supportive of the proposed accessory building.
