LEMAY AVE. - PDP - 12-07 - REPORTS - MODIFICATION REQUESTApplication for Modification of Standards Driveway This application is a request to allow a modification of setbacks along a lot line at 1635 South Lemay Avenue in Fort Collins. In Section 3.2.2(J) of the City's Land Use Code (LUC) it states that, "Any vehicular use area containing Six(6) or more parking spaces... shall be set back from the ... side and rear lot line ... minimum average of 5 feet. We are in compliance of this minimum setback rule for the first 65 feet entering the driveway. However, once past this distance the average width between the lot line and the structure (house) is 13 feet and 6 inches. This area is a driveway accessing a garage and rear employee / handicap parking lot. We are proposing putting a 10 foot wide paved driveway, leaving 3 feet and 6 inches of area for setback and structure buffer. We are therefore requesting the setback be reduced to 2 feet and 6 inches between the north edge of the driveway and the property line. This would leave 1 foot between the structure and the edge of the paved driveway plus the 10 foot of paved driveway. Please refer to the attached picture as there is an additional 2 foot 6 inches between the lot line and 6 foot privacy fence that belongs to the neighbor to the north. This request is in accordance with the city's Modification of Standards, Section 2.8.2(H)(3). The section states that "exceptional or undue hardship" is criteria for modification of standards. We would not be able to conduct this business under the existing setback restrictions, as the access to the rear garage / parking areas is critical to this lot configuration. We feel this would be the best plan for the surrounding area as well as the proposed business. We are committed to making the property a beautifully improved addition to the neighborhood.
