By this Restrictive Covenant (the "Covenant"), FORT COLLINS VETERINARY
INVESTMENT GROUP, LLC, hereinafter called the "Covenantor," does hereby covenant
and agree as follows as of the _ day of June, 2012:
1. Covenantor is the owner in fee simple of all the land commonly known as 806 S.
Lemay Ave., Fort Collins, Colorado 80524, more particularly described in Exhibit A attached
hereto and incorporated herein by reference ("Tract A").
2. Covenantor is the owner in fee simple of all the land commonly known as 816 S.
Lemay Ave., Fort Collins, Colorado 80524, more particularly described in Exhibit B attached
hereto and incorporated herein by reference ("Tract B" and together with Tract A, the
"Restricted Land").
3. Covenantor intends to construct improvements that span across the boundary line
between Tract A and Tract B, and has agreed to grant this restrictive covenant in order to obtain
the permissions necessary to build such improvements.
4. Covenantor and Covenantor's successors and assigns (i) will not ever deed, sell or
otherwise transfer Tract A to another party, without simultaneously transferring Tract B to the
same acquiring party, and (ii) will not ever deed, sell or otherwise transfer Tract B to another
parry, without simultaneously transferring Tract A to the same acquiring party. This Covenant
shall not prohibit any transfer of a portion of TractA or Tract B to a condemning authority upon
condemnation for a public or quasi -public use.
5. This Covenant shall be binding upon the successive owners of any portion of the
Restricted Land and constitutes a covenant running with the land for the benefit of the Restricted
Land.
. 6. The parties hereto agree that this Covenant shall be recorded with the Recorder of
Larimer County, Colorado forthwith.
7. The rights and obligations set forth in this Covenant bind and benefit the
affiliates, successors and assigns of Covenantor.

forwarding it to our survey department today for review and should have comments (if any) back to you on the 301h
when we have our staff review.
Attached is the Right of Way dedication language for your surveyor that needs to be completed, signed by owner,
notarized and certified by the owners attorney.
