Re: Fossil Creek 392 Annexation &Zoning - #32-09
This memorandum represents a follow up to the phone conversation staff had with you and city staff on
November 18, 2009, regarding the Fossil Creek 392 Annexation & Zoning item #32-09.
The City of Fort Collins and Town of Windsor staff met on November 17, 2009 as part of an on -going
monthly Funding Team meeting. This group is coordinating design and potential funding for the
reconstruction of the I-25/SH 392 Interchange. At this last meeting, staff recommended informing
property owners or representatives adjacent to the Interchange, of potential future funding participation
for interchange improvements.
As part of the Stakeholder Group involved in the development of the I-251SH 392 Interchange
Improvement Plan, you are aware of the challenges in funding this project. The Plan identified
conceptual future funding scenarios involving both private and public participation. Based on feedback
from area stakeholders, staff is well aware of the need to develop a fair solution for determining a final
funding strategy. Any final funding scenario should be developed, where the burden on private interests
is equitable, based on a fair cost to benefit analysis. Staff informed you that both jurisdictions anticipate
some private sector participation, in conjunction with public funding, as part of any future approved
funding mechanism.
The Plan identifies the "Corridor Activity Center" (CAC) to include properties on both sides of the
Interchange identified for future commercial and employment land uses. Your property is located within
this defined CAC area. If any other properties move forward to prepare for a development project within
the CAC area, staff will provide this same information.
Staff is currently waiting for a decision on the Federal Grant Application and should receive this
notification in January 2010. Staff anticipates discussions on a preferred future funding scenario will
resume after the results of this decision is available.
