Dear Mr. Olt:
The Town of Windsor Planning Commission reviewed this referral at its regular
meeting of October 21, 2009, even though neither the applicant nor any representative of the
applicant was in attendance at the meeting.
The subject property is located outside the Town of Windsor's Growth Management
Area (GMA) but within the Town's Community Influence Area (CIA). The subject
property is in the Corridor Activity Center (CAC) as defined in the Intergovernmental
Agreement between Ft Collins and Windsor dated March 22, 2006. Additionally the subject
property is located within the boundaries of the Fossil Creek IGA regarding annexations in
the Fort Collins Cooperative Planning Area adjacent to the Fossil Creek Reservoir and is
subject to the 1-25 Corridor Plan and Development Standards.
The subject property is depicted as Community Separator on the Town's Land Use
Plan map. The Windsor Comprehensive Plan states that the Community Separator land use
depiction provides for areas of open space and open lands which generally have little or no
development, with the exception of agricultural activities. The application materials
propose to annex with a commercial zoning. Although the subject property is depicted as
Community Separator on the Town's Land Use Map, the cooperative efforts of the Town of
Windsor and the City of Fort Collins over that past few years to secure funding to improve
the I-25 interchange anticipate that the subject property may develop commercially.
Pursuant to existing IGAs with the City of Fort Collins, the SH392/I-25 Improvement
Plan, and the I-25 Corridor Plan and Development Standards the Planning Commission
recommends the following to the City of Fort Collins:
(1) The zoning of the property shall be consistent with the CAC.
(2) The development of the property shall be consistent with the I-25 Corridor Plan
and Development Standards.
(3) Provisions shall be made for the dedication of right-of-way as may be required by
the I-25 reconstruction project and all other applicable roadways.
