Also a drainage swale behind these lots will need to be shifted an additional 5 to 10 feet to the west on the Grading Plan. I met with Wes Lamarque and Jay Barber on the site and they stated they are willing to provide written authorization in favor of this modification to the PDP stating it will have no negative effect on stormwater drainage. Please consider this request and let me know if transferring the property as specified in this request is or is not acceptable to you. The land transferred was designated as open space in the PDP. Prior to the transfer the neighboring property owner who purchased the property and I had extensive discussions with the City of Fort Collins Stormwater, Current Planning, Building & Zoning and Natural Resources departments. This land transfer was found to be acceptable and verbally authorized by all the departments contacted. After transferring the property we were contacted by additional neighboring homeowners in The Ponds who were interested in being able to expand their backyards and wanting a similar deal. Currently nine neighbors are requesting to purchase an area extending the width of their lots a distance of 15' to the north. Each of these 6 lots are approximately 70' wide which increases each lot by approximately 1050 square feet and is a total of 9821 square feet. Adding the 9821 square feet to the already transferred 3301 square feet reduces are existing open space in the Foothills Residential zone by 13,122 square feet. The current PDP submittal designates 8.22 acres or 54 % of the RF zone as open space. The 13,122 square foot transfer would reduce the RF open space by .30 acres or 2%, leaving a 51 % open space designation in the RF zone. Under the Foothills Residential zone definition, only 50% is required. This transfer does not effect the 4.57 acres of open space in the LMN zone or the Citys 3.7 acre detention pond.
