Dear Mr. Olt:
This firm represents The Ponds at Overland Trail Homeowners Association, Inc. The Association
understands that the developer of the Bella Vira project adjacent to the Ponds at Overland Trail intends to
construct a trail on The Ponds open space common area to connect the Ponds open space with the Bella Vira
open space. Attached to this letter is an aerial photograph showing the approximate location of the proposed
trail on the Ponds common area.
By this letter, the Association is indicating its support of the trail extension across the Ponds common
area on the following conditions:
1. The Association and the developer of Bella Vira will enter into any necessary
easement agreement for the trail on terms and conditions reasonably satisfactory to the Association.
2. The final design of the trail must be approved by the Association's Board of
Directors. The trail will be located as far as possible from the Ponds houses in the vicinity so as to
minimize the impact.
3. The Bella Vira developer and, subsequently, the Bella Vira Homeowners Association
will enter into a written, recorded assumption agreement whereby the developer and the Bella Vira
Homeowners Association assume certain Association maintenance obligations under the Grant of
Easement and Amendment to Easement recorded with the Clerk and Recorder of Larimer County,
Colorado on October 17, 2003 at Reception No. 2003-0132384 (copy attached).
