As a residential use in the L-M-N zone, the building setbacks are 15-feet front, five -feet
side, and eight -feet rear. Please draw setback line indicating the distance of the eight
foot high fence from the front property line along Parker and the side property line
along Whedbee. In order to illustrate compliance with this standard, the property line
must be clearly delineated. Please label the property line on all sides. If these
setbacks cannot be met, then a Modification of Standard must be requested.
3. The eight foot high fence along Parker Street needs to be softened with additional plant
material.
4. The trash enclosure does not need to be eight feet in height. It can be reduced to five
feet.
5. Please clearly label the fence along the south and east property lines as six-foot, solid
wood.
6. See redlines for other minor comments.
The P.D.P. is ready for the September 17, 2009 Planning and Zoning Board hearing. The
P.D.P. includes two Modifications, and possibly a third if the eight -foot fence does not
comply with the building setbacks. Each Modification should be individually addressed in a
narrative that will be forwarded to the Planning and Zoning Board. The deadline for
providing materials to the Board's packet is Wednesday, September 9, 2009.

[5/8/09] Another round of review prior to hearing will be required if the modification to allow
the existing gravel parking is not approved. If it IS approved, I can get by with an informal
round of review if no other department is requiring a formal round.

[8/5/09] Thank you for your response to this comment and my other comments. Per our
discussion today, panic hardware will be installed in courtyard gates to facilitate safe egress
and also address security (entrance) concerns.
ACCESS/MEANS OF EGRESS: Please contact me so we can coordinate your need for
security, with emergency services' need for access. We can certainly make the two needs
co -exist. Also, I need to know how exiting occurs through the courtyard. Is there an exit from
the courtyard, directly to the exterior of the building? There does not appear to be on the site
plan, but the actual building does appear to have direct access. Please contact me to
discuss.

[7/28/09] The landscape plans need to accurately reflect the widened sidewalk along Parker
Street and other improvements shown on the utility plans. This includes saw -cutting the
short concrete wall along the driveway on Whedbee Street where it encroaches onto the
public right-of-way.

[7/24/09] The lot doesn't have to be paved if a modification is granted.
[4/27/09] The change of use requires the gravel parking lot to be brought into compliance
with 3.2.2 and 3.2.1 of the LUC. This means it will have to be hard surfaced, interior parking
lot landscaping, perimeter parking lot landscape (1 tree every 40'), etc.

[7/24/09] Response letter states that the dimensions are shown, but I don't see them.
[4/27/09] Need to show parking stall dimensions of what I assume are parallel spaces along
south lot line. They need to be a minimum of 8' x 23'. Show dimensions of drive -aisle
widths (24' required at 90 degree stall, 20' at parallel stalls, and 24' behind the 2 stalls next
to the southwest corner of the building).
Comments from Current Planning:
The new brick wall with the two -foot metal extension needs to be described as an
eight -foot high fence. Please add a note that at eight feet, the fence will require a
separate building permit and must be engineered and submitted with an engineer's
stamp.

[7/30/09] (FC) Please note — this comment is just be carried through for Final and the DA.
[5/6/09] This development is responsible for constructing the sidewalk where none currently
exists on this property; however, it was determined that in this case, it really wouldn't benefit
the neighborhood by constructing it at this time. It has been agreed that this development
will provide cash in lieu of the additional sidewalk to the west. An estimate for our review
and approval is due in Final Compliance and that amount will be added to the development
agreement and due prior to the issuance of the building permit.

[7/30/09] (FC item) Looks good! Just one thing though, for after the hearing and in Final
Compliance, could you show 15' radii on the sidewalk tapers and we'll need to round out the
sidewalk a little at the western driveway (but that's FC stuff). Add variance for the attached
versus detached sidewalk to line 48 of the general notes as approved for Parker and
Whedbee sidewalks.
[5/8/09] It was determined that the existing 1' widening of the sidewalk along Parker would
be removed and a 4' extension would be put in its place. The sidewalk would then taper to
match the existing width at the corner and no widening of the existing sidewalk along
Whedbee would be required. The existing timber retaining wall will be removed as well as
the concrete wall extending into the row along the south side of the driveway. In addition, <
minimum of 25' of the driveway from the bow will be paved or put in concrete to minimize
drag -out over the sidewalk and street.
