John,
Regarding required turnaround on any development proposal to the City of Fort Collins, Section 2.2.11(A)
of the Land Use Code does set forth the requirement that your Bella Vira Final Plan proposal is subject to
a 90-day revision re -submittal from the date of the last City staff comment letter, in this case
February 16, 2007. This was stated (in bold type) at the end of the comment letter. It was also reiterated
in a letter dated March 2, 2007 with attached comments from Tim Buchanan, the City Forester. Please
see the attached letters.
You have until Wednesday, May 16th to submit to Cameron Gloss, Planning & Zoning Director, a request
for a 60-day extension from May 16th (to July 16th). Just simply write a short reason for the need along
with justiification. You can e-mail your request to cgloss(a)fcgov.com. Again, this must be received ASAP
so that Cameron can render a decision on the request because Section 2.2.11(A) does state that: "If the
additional submittal information or revised submittal is not filed within said period of time, the development
application shall automatically lapse and become null and void".

I have had problems getting my final submittal turned around but we plan on
bringing it in May 23rd. I have been informed that this time period may
exceed a required time limit for us to respond. I have not been able to find
the specific information in the code that addresses this. We originally
submitted on January 17 and had a meeting with the city to review on
February 14. We did continue to receive comments from engineering up until
February 21st. Can you advise regarding this matter

We will be ready to re -submit our final in the next two to three weeks, however the 90 day revision
period will expire on May 16. We are requesting a 60 day extension to allow us the additional time
necessary to finalize our documentation.
Some of the issues that have contributed to the delay are:
♦ Complicated negotiations with CSU and the city for a ROW agreement and accompanying
construction and utility easements.
♦ Extensive negotiations between The Ponds HOA's various board members and their attorney to
obtain an offsite trail access and construction easement.
♦ Clarification of requirements for architectural guidelines of homes backing up to open space and
what format to present this information. In addition to this being a relatively new requirement
we had to start over with a new natural resource representative and few details to work with
from the predecessor.
♦ Clarification of standards for Overland Trail width and transition design. The cross section for
this four lane arterial is unique and the currently improved sections are an exception to the
LCUASS. We initially were working with a detail that turned out to be incorrect and have had
to revise.
♦ Revisions to the box extension design in Overland Trail to allow for a narrower design as
suggested by the city engineering department. Also our structural engineer has had to perform
extensive scrubbing of his drawings to address detailed comments that were not typical of prior
submittals. A utility conflict has also required additional effort spent devising a solution that had
to be coordinated with Light and Power and City Engineering.
♦ Because we have to provide reinforced concrete over a shallow water line near the
Elizabeth/Oveiland intersection, the City Engineering department requested that we incorporate
the citys new standard for concrete intersections at arterials. This has also been a significant
design revision to meet the CDOT standard and determine what the acceptable transition points
are.
City concern about shallow stormwater drains at four different locations under the street was not
a formal comment but came to our attention much later during discussions with engineering
about other comments. As a result our proposed design solutions for the problem did not get
started until late in the process. In fact we are still in the process of submitting ideas to Rick
Richter for this problem to solicit an informal authorization allowing us to deviate from the 24
inch standard at certain locations.

Dear John,
The City of Fort Collins has reviewed and approved your request for a 60-day
extension to the Bella Vira PDP Final Plan resubmittal deadline. With a 60-day
extension to the May 16th deadline, your new resubmittal deadline will be Friday,
July 13, 2007.
This extension will hopefully give you sufficient time to resolve outstanding issues
associated with the project that you have outlined in your request letter. Should
you need an additional 30-day extension beyond that provided, please make an
extension request prior to the July 13thth deadline.

After much careful consideration, I've decided to grant a 60-day extension to your PDP final plan
resubmittal. An electronic copy of my extension has been attached to this message. Should you need a
signed hard copy, please let me know and we'll get it mailed out to you.
