Plans were presented to anticipate the construction of one building with associated parking starting later this year with a second building being added later. The plans were approved in principle subject to the following conditions: 1. The Board of Directors shall approve the final plat with approval verified by signing an approved signature block. 2. The canal right-of-way shall be shown on the plat as being fifty (50') from the center of the canal labeled as being exclusive to The Lake Canal Company and any activity within the right- of-way requiring the -written approval of The Lake Canal Company. 3. Any proposed improvements encroaching upon the canal right-of-way will require The Lake Canal Company approving an adjustment to the canal right-of-way or The Lake Canal Company entering into an acceptable encroachment agreement before approving the final plat. The canal of The Lake Canal Company passed along the entire length of the north property line of this property. Access in this area is very critical. The Board of Directors met on at least two occasions with Mr. Bello to discuss the relationship of this proposal to the canal. The need for the canal right-of-way to be fifty (50') feet from the center of the canal was specifically discussed. The plans do not reflect the details that were discussed. Enclosed is a copy of a letter that was written by request of Mr. Bello at the meeting of the Board of Directors of The Lake Canal Company held July 16,2009 summarizing the discussions of that meeting. It is the position of The Lake Canal Company that the following items should be completed or noted before proceeding with this proposal: 1. A signature block should be placed on the plat, including the final plat, stating that 'The has reviewed these sheets and cooperated with the Owner to develop this plan. "To the maximum extent feasible, the height, setback, and/or width of new structures shall be similar to those of existing historic structures on any block face on which the new structure is located .... New structures shall be designed to be in character with such existing historic structures...." As such, the design of any new structures on the west side of the development should be compatible with the adjacent historic Inverness Farm property at 232 E. Vine, which may be individually eligible for listing as a Fort Collins Landmark. This can be accomplished with the proposed modern design for a building on the west side of the property if the height is kept to a minimum and attention is paid to the massing and materials. At our meeting on August 12, 2009, we suggested that a third floor could be set back from the lower two floors, and a break in the box -like construction could be taken at the front west comer and along the west wall at some point to prevent the appearance of the new structure looming over 232 E. Vine, and to make the massing more compatible with the historic property. We will work with the owner and his representatives to see how this can feasibly be accomplished. The current plan show crabapples and hawthorns used as street trees. The applicant needs to select a species from the street tree list. The Following landscape notes should be added to the plan: • The soil in all landscape areas, including parkways and medians, shall be thoroughly loosened to a depth of not less than eight (8) inches and soil amendment shall be thoroughly incorporated into the soil of all landscape areas to a depth of at least six (6) inches by tilling, discing or other suitable method, at a rate of at least three (3) cubic yards of soil amendment per one thousand (1,000) square feet of landscape area. • A permit must be obtained from the City forester before any trees or shrubs as noted on this plan are planted, pruned or removed on the public right-of-way. This includes zones between the sidewalk and curb, medians and other city property. This permit shall approve the location and species to be planted. Failure to obtain this permit may result in replacing or relocating trees and a hold on certificate of occupancy. • The developer shall contact the City Forester to inspect all street tree plantings at the completion of each phase of the development. All trees need to have been installed as shown on the landscape plan. Approval of street tree planting is required before final approval of each phase. Failure to obtain approval by the City Forester for street trees in a phase shall result in a hold on certificate of occupancy for future phases of the development. Page 1
