The plan as described; to me and presented on the grading plan from Apex Engineering, Sheet 4 of 14, dated 9/9/09, is acceptable to me so long as the pond performs as intended and does not introduce excessive contaminants to the Coy Ditch. If the pond does not perform as anticipated and storm water spills out of the pond, the owners will take necessary steps to modify the pond to protect the Coy Ditch water quality so as not to allow excessive contaminants to flow into the ditch. Assuming the pond works as proposed, we have no objection to the proposed design and will support the project by signing the required documents so long as it is clear that our signature stipulates that the pond must not introduce excessive contaminants to the Coy Ditch as a result of its failure to perform as anticipated.
