The second floor can't overhang the lower front or side exterior walls (Sec. 4.9(E)(1)(d). A
modification will be required to allow what is proposed.
The applicant requests a Modification of FCLUC 4.9(E)(1)(d) to allow the proposed
building as designed which is represented on Site Plan PDP-02 and Elevations PDP-03 &
PDP-04, for the following reasons.
1. The proposed building design will promote the general purpose of the standard for which the
modification is requested equally well or better than would a plan which complies with the
standard for which this modification is requested (Refer to FCLUC 2.8(H)(1). The proposed
building design will not diverge from the standards of the FCLUC except in a nominal way.
(Refer to FCLUC 2.8(H)(4)). The proposed building design, specifically the second floor
overhanging the first floor on the south side of the project, contributes in a positive way as
follows:
a. Maintains the majority of the existing traffic flow through the site via the two existing curb -
cuts therefore minimizing the traffic on the alley adjacent to the residential zone on the west.
b. Retains as many on -site parking spaces as is possible minimizing the impact on the on
street parking in the immediate area.
c. Does not represent a negative building design feature, but indeed contributes to an
attractive building design that will contribute positively to the aesthetic of the neighborhood.
•2. The proposed project will substantially alleviate an existing, defined and described problem of
citywide concern which is the flight of private sector employment from the downtown area. The
proposed project will result in a substantial benefit to the city by retaining a large and swiftly
growing private sector employer in the downtown. (Refer to FCLUC 2.8(H)(2)).
