College Ave. Suite 10 WEBSIrthernengineering.com Fort Collins, CO 80524 FAX: 970.221.4159 October 20, 2011 This letter and attached exhibit are intended to serve as the application to obtain a grading/development permit for earthwork activities within the FEMA regulatory Cache la Poudre floodplain. The subject property is located at the terminus of Wood Street approximately a quarter -mile north of the City of Fort Collins Utility Service _ Center. The site is owned by Sidehill Investment LLC. The land owner wishes to perform minor excavation on a portion of the property, noted as "Excavation Area" on the attached exhibit. The land owner also proposes to fill a portion of the property, noted as "Fill Area" on the attached exhibit. The proposed fill area was previously mined for gravel and the intent is to restore the ground to more closely match its historic condition. There are actually two excavation areas; both of which are located outside of the Cache la Poudre 6-inch floodway, and are within the 100-year flood fringe of the Poudre River. The first excavation will remove a berm of concrete rubble. Said berm is not currently recognized by the floodplain modeling; therefore, there will be no change to the effective floodplain boundaries. The second excavation area will expand a small pond in the southeast corner of the property. The pond excavation is located in an ineffective flow area, and there will be no effect to the floodplain boundary or base flood elevations as a result of the proposed excavation. The fill area is also located outside of the Cache la Poudre 6-inch floodway, and is within the 100-year flood fringe of the Poudre River. The proposed fill location is within a backwater area that does not convey water in the principal downstream flood flow direction. By definition, fill can be placed in such ineffective flow areas without obstructing any further conveyance and without changing water surface elevations, flow velocities, or floodplain boundaries. The proposed earthwork activities are allowed within the FEMA regulatory 100-year flood fringe for the Cache la Poudre River. The will be no changes to the effective floodplain boundaries or base flood elevations as a result of the excavations or fill. Be advised; however, that the land owner does intended to apply for a LOMR-F with FEMA after the fill has been placed in order to revise the mapped flood fringe. I have coordinated with several other City departments including Current Planning and Natural Resources. Our comments are as follows: 1. The plan shows fill taking place where there are existing homes. Furthermore, some of the fill may be shown where the existing septic clean -out location is located. The fill is also shown across the road, which would be an emergency access issue. The fill in these areas seems premature. Staff would suggest a phased approach. Show the fill that can be done without impacting the existing road and structures as Phase 1. Later, after all of the structures have been removed, then the remaining fill could occur as part of a separate permit and plan. Both phases could be combined into one LOMR-Fill while still in the County. 2. The excavation areas do not show any proposed grading. This is of importance especially in the excavation area 2. This is a pond that the applicant has proposed using as both a water feature for the site's future residents and to use the outflow of that feature to support the vegetation in the floodplain. Staff is initially supportive of this concept. While we do not believe this excavation will preclude such a feature from being developed in the future, we do want to make sure this overall vision is maintained throughout the process. 3. The fill may not be high enough to show the area removed from the floodplain at the northwestern portion of the fill area. Spot elevations will need to show that the fill is above the BFE. Staff would suggest reviewing the grading plan and giving yourself some extra fill amount to make sure you are at least above the BFE for the LOMR-Fill. 4. City staff would like to have a note on the plan that acknowledges that any future structures in areas removed from the floodplain by a LOMR-Fill will be required to have the lowest floor (including basement), HVAC, electrical and other mechanical elevated two feet above the 100-year flood elevation. 5. To support the statements made in the memo regarding the fill being in an ineffective flow area, it would be helpful to have a drawing/calculations that supports this statement (See the draft memo from Brian Varrella for guidance). 6. City staff would request that the floodway for the West Vine and Poudre River floodplains be staked in the field prior to work commencing so that no construction activity take place within the floodway. This should be a note on the plans
