Hello Cary, I received your voice mail from last week.
We will not be requiring parking to be placed on the rear of the lot. I am surprised that
information was conveyed to you as it was not a result of last Wednesday's review meeting.
We will support Alternative Compliance for the number of spaces.
We will support a Modification to the Build -To Line and Connecting Walkway, subject to the
design revision as discussed, and agreed to by your team, at the Wednesday meeting.
I thought the meeting went well. We arrived at consensus on a number of issues. I was,
therefore, surprised at the tone of the voice mails and a -mails following the meeting from
people who were not even at the meeting.
We are on schedule for an Administrative Hearing for the replat this week. Your team needs
to coordinate with Jim Mokler's team regarding the placement of a drainage easement,
emergency access easement and sidewalk easement (if necessary) on the replat. Or, if not
on the replat, then by separate legal documents by your team. Note that there is a fee of
$250 per easement if you go with separate legal documents versus the replat. Both options
are available to you and Mr. Mokler.

Ted,
This is not what was communicated by our three representatives present based on their professional opinions.
They also stated that you questioned the validity of what I had communicated to you and your staff about the
required start date of this program. I was informed Wednesday the afternoon of 3rd. (after your meeting with
my representatives) by Emme that you had not reviewed or received the Variance Request for the number of
parking spots needed nor had you reviewed/received the Modification Report for the building set up as you
stated that you still needed these. These were sent to Emme the previous week (January 27th) and honestly I
was a little shocked by this as the Executive Director on Thursday the 28th of January contacted me wanting to
know who you where and why you were calling him. My representatives also indicated that you had contacted
someone at the state and that individual stated that there was no required start date for this program. This is
contrast to the contract I have in my hands reflecting that this program is to start by September 2010 as well as
the fact that contacted my counterpart to confirm this and he stated that this was not communicated to you
and the only issue discussed was the required parking spots. I'm not sure who you spoke to.
We will need an additional 5-10 parking spots to meet all parties involved requirements over what we have
submitted prior, so this might be another issue for your department.
I'm also in question as to the additional comments brought up at this meeting requiring an 8' landscape buffer
now when the initial site plans have been in the hands of the City of Ft. Collins since September and nothing
was ever mentioned regarding this requirement in the numerous meetings prior to the 3rd with Civil, Site and
Buildings already designed without this consideration. The bottom line is that mandating the landscape
barrier, removal of the deceleration lane (which CDOT didn't require during their analysis of the curb cut
request), requiring additional drainage reports and essentially moving this building back the 8' feet will make it
nearly impossible to build on this site. These last minute requirements and my overall concern as confirmed by
our team that this project will not be permitted in the near future has placed a very large question mark on this
project and its future. Wednesday February 3rd, the City of Ft. Collins (per our agreed to schedule) was to
provide us with comments (we have received nothing to date) and thus meeting the requirement to re -submit
this coming Wednesday with all the changes brought up at this meeting, but yet to be received in writing will
delay us a minimum of 3-4 weeks. I have no confidence based on past and current performance that this site
will get approved in the future without serious financial constraints that I'm not willing to commit too at this
time with no assurance that we will be approved anyway. We are not committing to any of the requirements
as verbally expressed (I would like the comments in writing this morning) but we will be prepared to address
these on Wednesday at the scheduled meeting.
