owner as we already have rights to use the easement. Can we proceed without this letter of
acknowledgment?

Good.point. Also, do we really save any money by putting easements on plats? For what little we might
save, is it really worth it considering these potential difficulties later on? SLS

This is one of the problems with the lack of detail we have in our easements dedicated on plats. When
we get easements by agreement, we cover the details about construction of improvements, maintenance,
restoration, etc. so there is no question later. But the plats don't.

It appears that the whole tract (F) is a public utility easement so it stands to reason that we shouldn't
have to obtain a TCE. The rest of our work will be in the ROW. But since Tract F is essentially Jon's
property do you think he's worried about getting agreement from us to restore the property to existing
condition after the RCP and outfall structure is installed? SLS

If you are going outside of the permanent easement during construction, you need a temporary
construction easement. Otherwise not.

Steve, I'm have never used the TCE acronym but figured it out. I guess it is a question for Paul, but
usually a temporary construction easement is only needed if the construction will disturb area outside of
the drainage easement. Does anyone else want to weigh in on this?

Jon's office manager said something about negotiating an easement. Do they think that maybe there is a
TCE required? SLS

Emma, I'll give Jon a call and see what his issue is. Just by me talking to him I can waive the
acknowledgment letter because I will know he is aware of the project. I'll send you a confirmation that I
spoke with him. We can put that in the file.

I talked with Paul this morning and apparently Jon Prouty does not want to write us a letter of
acknowledgment regarding the use of the drainage easement on his property.
