We have received your request for a proposed utility easement related to
the City's South Transit Center project. Please let this letter serve
as our acknowledgement of your interest in further discussing the
possibility of granting an easement for stormwater purposes.
Understand that this letter is not intended nor should be interpreted as
intending to be an agreement to grant said easement. No easement shall
be granted until such time the parties mutually agree to terms and
conditions of an easement and a formal fully negotiated agreement has
been executed.
Furthermore, in the event Lagunitas Diversified Projects, LLC finds i
necessary to obtain legal counsel for the purpose of garnering legal
advice in regards to said easement, we will require the City of Fort
Collins to agree in writing to pay for our legal services related to
this matter.

Jon,
In response to your email, as shown at the end of this message, there is no easement needed for the
South Transit Center (STC) project because there is already a drainage easement on your property. We
were just requiring that the STC design team inform you of the proposed outfall pipe being installed in
the easement. This was just a courtesy and we wanted acknowledgment that they had done so. I think
the email you have already sent does that.
They are required to stabilize the area of disturbance and plant it with the same vegetation. I would
think that would be your main concerns. The area of disturbance should be minimal. I am not aware of
any sprinkler system or other utilities in that area, other than what is shown on the design plans. If there
is something else please let us know.
If you want to see the detail of what they are proposing, give me a call and I will get you the information.
I tried to call you yesterday, and left a call back message with your receptionist. Please give me a call if
you have questions.
