RE: Waters Edge
I am writing this on behalf of my client, Skyland Meadows Development, to formally request an
extension of the three year approval period of the PDP by six months as allowed in Section 2.2.11(c)
of the Land use Code.
As you are well aware, the market forces have changed considerably since this project was first
conceived in 2005, and even since our PDP approval on Jan 18, 2007. We still believe this to be a
viable project, but we are being forced to wait out the current economy, and more importantly the
credit crunch that has brought virtually all development work to a halt. Since our approval in 2007 we
have done submitted final plans and have largely completed that process. When those plans are
recorded though, it does start the clock ticking on the vesting and infrastructure requirements. At this
point in time, financing of this project is not feasible to begin the installation of infrastructure. However,
over the last several months, we have been working with ELCO and various water attorneys on water
rights, more specifically the use of raw water on this project. If we are successful, it would
substantially improve the viability of this project.
If the extension is approved, we have every intent of completing the final plan process, and recording
the mylars, plat, development agreement, etc. within the extension period.

The City of Fort Collins has reviewed and approved your request for a six month
extension to the Water's Edge @ Richard's Lake PDP, originally approved on
January 18, 2007. Based on this extension, a Final Plan in accordance with the
City of Fort Collins Land Use Code must be approved no later than July 18,
2010.
Please note that the code does not authorize further extensions and failure to
receive Final Plan approval by July 18, 2010, will render the Water's Edge @
Richard's Lake PDP null and void.
