MELDRUM ST.) - FDP - 35-09/A - SUBMITTAL DOCUMENTS - ROUND 1 -M wi With regard to the nominal argument, we're not talking about a small 2nd floor cantilever, but rather a very large 2-story overhang. So I'm not sure this can be considered nominal, inconsequential - going from no overhang to a 2-story, 40' x 1 10'overhang. If they can't re -state their case, it may be that the decision maker will have to determine that this alleviates an existing problem of city-wide concern as the justifcation for granting the modification. Subsequent to these comments the City staff determined that this was not a requirement of this project and did not require a Modification. [12/22/09] [11/20/09] The second floor can't overhang the lower front or side exterior walls (Sec. 4.9(E)(1)(d). A modification will be required to allow what is proposed. Number: 22 Created: 11 /20/2009 [12/28/09] With regard to Modification Request 01: I'm not convinced that they really addressed the 'equal to or better than' criteria, or successfully explained how this is a nominal divergence. For instance, the code prohibits the overhang, so I think they need to explain why the overhang is equal to or better than a plan that doesn't have it. They explain that it maintains the existing traffic flow and retains on -site parking, but I don't believe the purpose of the standard is to preserve the traffic flow and number of parking spaces. And anyway, those are arguments that apply equally to a building that doesn't have the overhang addition. I assume they mean that if they were to construct a 1 st floor addition under this portion of the 2nd and 3rd floors, then there wouldn't be an overhang and it would comply, but then the traffic flow and amount of parking would be negatively affected, and therefore it's better to have no 1 st floor. The problem with that argument would be that they couldn't build a 1 st floor addition under the overhang since they've already maxed out the allowable floor area. Paoe 3 ft 40 on the grading plan, however adding a very small highpoint just to the east of where the curb cut into the swale is should be added to ensure that low flows enter the swale and does not continue down the flow line and into the sidewalk ramp. The grading and plans have been updated to represent detail D10-B. Let's continue to work together to resolve the few oustanding issues (FDC location, Knox Box location(s), etc. The FDC has been located on the Site Plan, off the southeast corner of the building, approximately halfway between the building and the property line and approximately 4 ft. behind the curbcut curb with a note that requires the contractor to coordinate the final location with Poudre Fire Authority prior to installation. Two Knox Boxes have been indicated on the Site Plan: 15` next to the fire riser room access door (refer to door on south wall of building) and 2nd on the exterior building column just north of the main building entry on the east side of the building. Number: 51 Created: 12/17/2009 After reviewing plans again and considering the technicality of the Fire Code when it concerns emergency vehicle access, we reallly need do extend the Emergency Access Easement along the drive aisle, west to the edge of the property. While this means exceeding our 150-foot max length for a fire lane (meaning we should have a 100-foot diameter turnaround), I think it's more important to ensure that buidling is technically within access. This is an existing structure and you don't have room for the turnaround. The Emergency Access Easement has been revised to show it extending to the alley on the west side of the property. Refer to the Site Plan and the Utility Plans. An exhibit and legal description has been included with this submittal. Number: 60 Created: 12/23/2009 [12/23/09] The sidewalk chase that drains the North drive entrance will need to be built according to standard detail D10B and should include a concrete pan running from the walk out to the curb as well as the 1 foot flares in the sidewalk to protect pedestrians from walking into the swale.
