(specifically Division 4.5, Low Density Mixed -Use Neighborhood
District), at least to the extent of its original compliance (so as to
preclude any greater deviation from the standards of this Land Use
Code by reason of such amendments). Copies of Article 3 and
Division 4.5 are available in the Current Planning Department or
on the City of Fort Collins website @ www.fcgov.com. Go to
Departments, then the Current Planning Department.
9. The City's Zoning Department will coordinate the Minor
Amendment development review process. The required submittal
package will be submitted to the Development Review Center
and distributed accordingly to other City departments and outside
reviewing agencies involved in development review.

g. Engineering will need to review the revised subdivision plat.
h. A Development Agreement may be required for the
replatting of the property.
The Transportation Development Review Fee will apply
and will be collected by the Engineering Department at time
of submittal of the change -of -use request. Please contact
Randy for the exact amount of fee to be paid.

3. Roger Buffington of the Water/Wastewater Department
indicated that no changes are proposed to the existing water and
sanitary sewer services, and there will be a Homeowner's
Association that is responsible for the water & sanitary sewer
monthly billings; therefore, no comments. Please contact Roger, at
(970)221-6854, if you need additional information.
4. Glen Schlueter of the Stormwater Utility indicated that he has
no comments since there are no changes proposed that affect the
drainage or drainage easements. Please contact Glen, at (970)224-
6065, if you need additional information.
5. Light & Power Department had no comments to offer. Please
contact Rob Irish, at (970)224-6167, if you need information on
electric service to the property.
6. Carie Dann of the Poudre Fire Authority (PFA) indicated that
there will be no change of occupancy designation with the replat.
Please contact Carie, at (970)416-2869, if you need additional
information.
7. This development request will be subject to the Development
Review Fee Schedule that is available in the Development Review
Center office. The fees are due at the time of submittal of the
required documents for the appropriate development review
process by City staff and affected outside reviewing agencies.
8. This development proposal is subject to all applicable
requirements set forth in the City's LUC, specifically Article 2.

b. The request is to replat Eastgate, 2nd Filing into 4 lots and
Tract A and change the 4-plex multi -family residential
building into 4 single-family attached units. The proposed
change must satisfy the applicable landscape standards set
forth in Section 3.2.1 of the LUC.

2. Susan Joy of the Engineering Department offered the following
comments:
a. The standard utility plan submittal requirements may apply
to this development request. Please revise the old utility
plans or submit a new set titled something different.
b. Street oversizing fees may apply to this development request.
The fees are based on vehicle trip generation for the
proposed land use in the development plan. Please contact
Matt Baker of Engineering, at (970)224-6108, for detailed
information on the fees. The fees, if applicable, will be
collected at the time of issuance of building permits.
C. The Larimer County Road Impact Fees will apply to the
replatting of the property.
d. A Transportation Impact Study (TIS), addressing all modes of
transportation, may be required or waived with your Project
Development Plan (PDP) submittal. Please contact Joe Olson
of the Traffic Operations Department, at (970)224-6062,
and Denise Weston of the Transportation Planning
Department, at ((970)4162643, to determine what
information might be needed in the TIS pertaining to Level of
Service (LOS) for vehicle, pedestrian, bicycle, and transit
modes of transportation.
e. Any public improvements associated with this development
will be subject to the requirements set forth in the Larimer
County Urban Area Street Standards (LCUASS).
f. Any damaged curb, gutter, and sidewalk must be repaired or
replaced with the building expansion.

Request to change the existing 4-plex multi -family residential building to
4 single-family attached dwelling units by replatting Eastgate, 2nd Filing
to include individual lots for each dwelling unit (the property owner's
intent is to change the units from condominiums to townhomes). The
property is located on the east side Montgomery Street at McHugh Street,
just south of Riverside Avenue. It is in the LMN, Low Density Mixed -Use

comments:
a. This property is in the LMN, Low Density Mixed -Use
Neighborhood District, which is Division 4.5 of the City's
Land Use Code (LUC). The request could be processed as a
Minor Amendment to the existing Site 8a Landscape Plans
per Section 2.2.10(A) of the LUC, which states:

For your information, attached is a copy of the Staff s comments
concerning the request for Eastgate Replat, Change a 4-Dwelling Unit
Building from Multi -Family to Single -Family Attached, which was
presented before the Conceptual Review Team on June 16, 2008.
This is a request to change the existing 4-plex multi -family residential
building to 4 single-family attached dwelling units by replatting Eastgate,
2nd Filing to include individual lots for each dwelling unit (the property
owner's intent is to change the units from condominiums to townhomes).
