Dear Mr. Shepherd:
WMS Investments, LLC is the property owner of 4700 Innovation, Suite B3 located
within the Oakridge Business Park and Rod Arndt is the managing member.
We are in support of allowing the change of use to Wholesale Distribution for the
above property. The property was developed prior to the Land Use Code and is well
suited for a wholesale distributor.
WMS Investments would also encourage the Planning and Zoning Board to consider
approving the change of use for the adjacent properties along Innovation Drive.
When the buildings was developed and constructed they were under the LDGS
guidelines. Covenants for the Oakridge Business Park prescribe a number of allowed
uses, one of which being warehouse/distribution which would have allowed for the
proposed uses. Neighboring users currently include a mix of office, wholesale,
warehouse, distribution and manufacturing uses.

Pursuant to your letter of August 7, 2008, regarding the above -referenced development proposal,
the Board of Directors of OakRidge Business Park Association, Inc. (the "Association")
unanimously supports the addition of this use, Wholesale Distribution, for 4800 Innovation Drive
(the "Building"). We believe this is appropriate considering the prior tenancy, the design and
construction of the Building, and its location within OakRidge Business Park.
Additionally, should the Building be granted the new use, the Association will monitor trucking
activities for any negative impact on the surrounding area. Since the Association covenants
permit warehousing as a usage, we would advocate extending this as an allowed use in the light
industrial portions of OakRidge Business Park.
We appreciate your consideration in this matter and look forward to a favorable outcome.

A notice of rezoning was delivered to our home regarding the re -zoning of a portion of Innovation Drive to allow a
distribution center to begin operations there. Unfortunately, I can not attend Thursday's planning commission
meeting to participate in the public comment forum.
As an alternative, I would like to voice a "please do not allow" vote.
I am concerned about large trucks constantly moving in and out of the area which will only increase the traffic
problems already present in the Harmony/Timberline area. With the volume of traffic, especially with the new mall
opening up, it does not make sense to me to encourage semi -trucks to use this artery into the city. It would seem
to me that there are numerous other venues available for this prospective tenant to utilize that are much closer to
1-25 or other established truck routes through/around the city. If this was a manufacturing facility and these trucks
were simply distributing goods as part of daily business, I would not have any problems. But if this is simply a
distribution hub that does nothing but shuttle goods in and out, there has to be better locations that the city has
already designated for such a purpose. I am also concerned because I do not think McMurray is currently
configured adequately to handle a constant barrage of large trucks turning right onto Harmony. These trucks will
be a significant hindrance to maintaining optimal traffic flow as they will be utilizing oncoming lanes to negotiate
the turns.
If allowed in this location, it would be my guess that trucks would also increase westbound on Harmony, both
directions on College/287 and Timberline. This location, being so far from 1-25 with available alternate routes
prior to getting back out on 1-25 would also provide a convenient excuse for illegal trucking operations to bypass
the inspection station on 1-25. As evident from a recent police "sting", this is apparently a problem that this
distribution center will only encourage.
Thank you for your time. I wish I could be there to voice my opinions at the designated time, but I will be away on
business during the hearing time.
