Oval Flats is the new mixed -use project at the northwest corner of West Laurel Street and South Howes Street that will replace the existing Sigma Alpha Epsilon (SAE) fraternity house. I informed Mr. Young that the Oval flats, PDP has been through the City's development review process and went to a Hearing Officer at an administrative hearing on February 2, 2009 for a decision. The project is for a 4-story building containing a total of 48 residential dwelling units (some on all 4 floors), about 4,500 square feet of commercial/retail uses on the ground floor, and about 3,000 square feet of space for an SAE lodge room on the ground floor. There will be 68 parking spaces on -site. The project is in the City's Transit Oriented Development (TOD) overlay zone as defined in the Land Use Code, which does not require a minimum amount of on -site parking for residential uses. In this case, the number of parking spaces is approximately 20 spaces less than the minimum number required if the project were located outside of the TOD overlay zone. The Hearing Officer did approve the Oval Flats, PDP (without conditions) on February 4, 2009. There were about 7 - 10 members of the public (affected property owners and other interested parties) present at the hearing and their primary concern was about the amount of on -site parking being provided since it was less than normally required for residential uses. There was discussion about the City's TOD overlay zone and how it will require a "wait and see" position as projects begin to come on-line in the overlay zone.
