use in the Downtown District. The applicant is therefore proposing an intensified use under the
code which should require additional scrutiny.
Permitting a 24 hour retail operation on this site is most definitely not compatible with
the immediate surrounding neighborhood which primarily includes professional office
businesses and residential both east and west of the site. I have no doubt that if this use is
permitted, Clocktower Square will experience additional significant problems with vandalism,
etc. because people will be hanging out at 7-11 at all hours of the night right next door to our
building. We already experience significant problems with vandalism, the homeless, tagging, etc.
This is primarily the result of young intoxicated people walking home from the bars in old town
late on Friday and Saturday nights.
In summary, this proposed use is fundamentally incompatible with the surrounding
neighborhood and the application should be denied.

Thank you for providing me with your file materials on this pending proposal. I am one
of the owners of the Clocktower Square building located at 323 S. College Avenue, which is
immediately north of the subject site. I have reviewed the staff materials and the traffic study and
have a couple of comments.
First, with regard to the traffic study, the inclusions in Section 5.2 are so inaccurate as to
be laughable. It is absolutely not the case that the College and Magnolia intersection operates at
an acceptable level of service during peak periods. During peak periods, we have great difficulty
entering or exiting the parking lot onto College Avenue. Additionally, the intersection of College
and Magnolia is completely clogged during the 5 p.m. rush hour. It is not at all unusual to be
unable to cross College Avenue east or westbound on Magnolia Street because cars are backed
up completely blocking the intersection when there is a red light on north or southbound College
Avenue at Mulberry Street. The College and Magnolia intersection is most definitely not
operating at an acceptable level of service during peak periods.
Secondly, there can be little doubt that the proposed 7-11 will generate significant traffic
in the north — south alley which is immediately west of the Clocktower property. People will
quickly learn to avoid the jammed intersection of College and Magnolia and use the alley as a
public street for access to and from 7-11. That is unacceptable.
Third, the proposed access point from College Avenue onto the site will exacerbate the
College Avenue traffic flow problems. At the very least, a right turn in and a right turn out lane
should be required. There will also be significant difficulties accessing the site from Magnolia
Street given the short distance to the College Avenue intersection and the fact that traffic is often
backed up for the entire block. Of course, this is even worse when the trains go through on
Mason Street.
