Delich, P.E. 2272 Glen Haven Drive Loveland, CO 80538 RE: East Ridge Development — Vine/Lemay Capacity Reservation Dear Matt: I am in receipt of your letter dated February 21, 2007 regarding the Capacity Reservation at the intersection of Vine Drive and Lemay Avenue as it pertains to the East Ridge Development proposal. Please accept this letter as confirmation that upon submittal of a complete application on or before March 10, 2007, the intersection capacity reservations previously approved for the Vine/Lemay intersection will remain valid and effective for the life of the project. If the land uses assumed from the previous transportation impact study change significantly in the development application, then a reevaluation of the capacity reservation will occur.
