Blakely, ASLA Jim Sell Design, Inc. 153 West Mountain Avenue Fort Collins, Colorado 80524 Subject: Eastridge PDP Final Plan Status Dear Matt, The purpose of this letter is to clarify the status of the Eastridge PDP Phase I Final Plan application. I had sent you a letter on October 4, 2007 incorrectly stating that the application will become null and void with a failure to submit a revised Final Plan application by November 8, 2007. My interpretation of Section 2.2.11 is that the revised Final Plan submittal is only subject to subsection (C) that allows the applicant 3 years from the date of PDP approval to obtain approval of the Final Plan. Since the PDP was approved on January 12, 2006 the corresponding deadline for Final Plan completion would not be until 2009. As part of the 2008 Annual Land Use Code amendments process, the City will pursue a change to Section 2.2.11 modifying the text to match the purpose and intent of the deadlines. I apologize for the misinformation provided in my previous correspondence and the delay in getting this position back to you in writing.
