College Avenue Fort Collins, CO 80521 Re: Request for extension Ted: ATTORNEYS AT L A W l 0\� June 6, 2013 This firm represents East Ridge of Fort Collins, LLC ("East Ridge"), the owner and developer of East Ridge, an approved residential project located on the southeast corner of the intersection of East Vine Drive and North Timberline Road (the "Project"). The Project was granted final approval by the Director of Planning on July 13, 2009 as a site specific development plan with a three (3)-year term of vested property rights effective through July 13, 2012. On June 15, 2012, Laurie Kadrich, Director of Community Development and Neighborhood Services, granted an administrative, one (I) -year extension of the term of the vested property rights to July 13, 2013. Pursuant to Land Use Code Sec. 2.2.11(D)(4), East Ridge requests a second administrative, one (I) -year extension of the term of the Project's vested right from July 13, 2013 to July 13, 2014, and in support of its request, submits the following: (1) The Project complies with the applicable general development standards contained in Article 3 of the Land Use Code; and (2) The Project complies with the applicable zone district standards contained in Section 4.4 of the Land Use Code. Please see the attached memorandum from Terence Hoaglund, Vignette Studios, summarizing his review and conclusions regarding the Project's compliance with the applicable Land Use Code standards. College Ave. PO Box 580 Fort Collins, CO 80522-0580 970.221.6750 970.224.6134 - fax fcgov. com/currentplanning Staff has received the request for the second, successive, administrative, one- year extension of the term of vested rights for East Ridge Final Plan which would extend the vesting period to July 13, 2014. We have also received the letter from Mr. Terence Hoaglund, Vignette Studios, which indicates that East Ridge remains in compliance with the current requirements of the Land Use Code. This project was granted final approval on July 13, 2009 and was granted an initial vesting to July 13, 2012. The first, administrative extension was granted in June of 2012 which extended the time validity to July 13, 2013. The request for a second, successive, one-year, administrative extension is hereby granted in accordance with Land Use Code Section 2.2.11(D)(4). East Ridge Final Plan is now fully vested to July 13, 2014. Please note that any future request for a one-year extension of the term of vested rights can only be considered by the Planning and Zoning Board.
