HomeMy WebLinkAboutRIDGEVIEW CLASSICAL SCHOOL PHASE IV ADDITION - SPAR - 16-01A - CORRESPONDENCE - CORRESPONDENCE-HEARINGThe building is too large relative to the size of the lot; the property provides a ratio of less than three (3) times the total floor area as prescribed in Section 4.3(D)(1) of the City of Fort Collins Land Use Code; • Architecture of the proposed addition does not comply with the "Base and Top Treatments" specified in Section 3.5.3(D)(6) of the Land Use Code requiring all institutional building facades to have recognizable "base" and "top" treatments; • The proposed conversion of the Lemay Avenue access (south of the school) from right-in/right-out to a three-quarter access, by allowing traffic to enter from southbound Lemay Avenue, creates an unsafe condition; • The school violates the sharing parking agreement established in 1984 between the church (former building tenant) and Stuart Professional Park immediately north of the school across Stuart Street. This parking agreement was a condition of City approval for the Stuart Professional Park; • The size and operating characteristics of the school are too intensive given its location abutting a residential neighborhood; and • The proposed building expansion compounds existing compatibility problems with the surrounding neighborhood. Under the statutory provision, it was the duty of the Planning and Zoning Board to "review and comment" on the proposed expansion to the Ridgeview Classical School Plan within thirty (30) days after receiving the plan. Accordingly, the Planning and Zoning Board did review and make its comments on the plan and received the response from the applicant (the governing body of the charter school). Both the submitted plan and the response were not satisfactory to the Planning and Zoning Board as I shall describe in greater detail later in this letter. According to the statute, if the Planning and Zoning Board is not satisfied with the response to its comments, the Planning and Zoning Board may request a hearing before the Poudre R-1 Board of Education regarding the plan. The statute goes on to provide that the hearing shall be held within thirty (30) days after the request of the Planning and Zoning Board and that the charter school may then proceed with its site development plan, unless prohibited from doing so by School Board resolution. It is the School Board's responsibility to publish at least one notice in advance of the hearing, and provide written notice of the hearing to the requesting planning commission (Planning and Zoning Board). Therefore, the purpose of this letter is to request a hearing before your board to discuss the concerns of the Planning and Zoning Board regarding the proposed expansion to the Ridgeview Classical School.
