I could discuss those in greater detail with you as we get closer to a hearing. Paul Eckman, Deputy City AttomeA Request for Hearing - Ridgeview Classical School I received a call from Linda Conners, attorney for the school district, regarding the request for hearing for the Ridgeview Classical school. Bill Franzen was on the phone with Linda. First, if there is going to be a hearing it will be on June 21 st, most likely in the evening. We will know more later about the time of that hearing. Second, the school district is convinced that the charter school is going to be sued by the neighboring Stewart Professional Park over that shared parking agreement. Therefore, they think that it is premature for the Planning and Zoning Board and the School Board to hold this hearing on June 21 st. They think the hearing should be held in abeyance pending the outcome of that litigation. The proposal that was made to me was to either get the charter school to agree to hold the hearing in abeyance where the City agrees to waive its right to a hearing within 30 days and the charter school agrees to waive any right it might have to commence construction once the 30 day period has run. I suppose that would be okay with us, wouldn't it? The other alternative that was presented was to get the charter school is simply withdraw its application entirely and agree to reapply with the City once the parking lot litigation is resolved. This would require the Planning and Zoning Board to consider the matter once again based upon new facts about the outcome of the parking lot litigation. I suppose that alternative would be okay with us too, wouldn't it? Linda and Bill were going to talk to the folks at the charter school about these possible alternatives. Also, they observed that the June 21 st hearing date would probably be difficult for anyone from the charter school to attend, since they will all be away at some type of charter school convention. Even so, June 21 st is the last day that would fit within the 30 day window, and it only fits because the 30th day fall on a Saturday. 300 LaPorte Avenue • P.O.
