Fort Collins, CO 80526 September 13, 2001 Community Planning & Environmental Services Current Planning City of Fort Collins Dear Sir: We are writing to request that the lot at 725 S. Taft Hill Road be split. We propose that the back portion of the lot would be split into a separate 5490 square foot lot. The existing building on that space would be converted into a single family residence. In order to do this, we are asking for a modification to the Land Use Code concerning residential building standards 3.5.2.(D) (3) establishing rear yard setbacks at 15 feet. We would like to modify the setbacks on this lot from 2.8 feet to 2.9 feet as per plot plan. This would accommodate the already existing building. It is our feeling that we are justified in this modification under 2.8.2(H)(3) of the Land Use Code. We believe that this is an "exceptional situation unique to the property," in that the existing building at this address was constructed as a large garage with the original house in 1954 when setbacks were not at issue. The existing garage has been converted to a single family residence (without proper permits) by the previous owner. We plan to bring that building up to code as a single family residence. We do not foresee any detriment to the public good since we plan to create a legal residence out of what is now an unusable structure that only invites decay, vandalism or other problems. The setbacks do not in any way affect or impede vehicular, bicycle, pedestrian, or emergency traffic. There are no alley or neighbor proximity issues involved.
