I hope that outlines for you what I believe the situation accurately is. I certainly
understand what happened now, which appears to be that the project was represented
in most respects and we intended that our application be for 41 units and based on the
elements above, 41 units were approved. HoWpver, an error was made in not reflecting
this in the numbers in the box.
I think the procedure for correcting this error is to reopen the hearing, further consider
everything above, maybe accept receipt of our application amendment and correct the
record.
Please give me a call.
Thank you.
Sincerely,
Jon Prouty

Re: Manhattan — 41/38
Dear Cameron and Steve:
Following up my phone call, I have
this matter very carefully and believe:
1. This is not a change from %8 units to 41 units.
2. It is an error that needs y6 be corrected by reopening the hearing and correcting
the record.
In further explanation:
1. On the site plans a submitted prior to the last review and hearing officer
decision, the site tans indicated "HA" in three places, which indicated handicap
units below the wnhouse units overhead, which brought the total number of
new units to 41. Unfortunately, this was not reflected in the number of units
indicated in the box to the right.
2. In the elevations submitted prior to the City review and hearing and decision, the
handicap units were reflected, which again indicated a total of 41 new units.
3. When we brought in our final submission, we brought in an application
amendment to correct the number of units rior to hearing officer hearing from 38
to 41.
The application was refused as not necessary as is indicated by
contemporaneous notes in our file as well as the fact that both our file copy and
the original signed copy are in the same pre -final submittal file.

Re: Manhattan — 41/38 Units Problem
Dear Cameron & Steve:
Thank you for meeting with me about this Thursday. Enclosed is my previous memo
together with the additional information which came to light at our meeting which was
that prior to our submittal we added nine detached garages which were added to
provide for the units (3 over each HA unit) which had their garages displaced by the HA
units, bringing the total number of garages to 41. This number of 41 garages was also
reflected in the land use data box.
Accordingly, you will see in bold that I have added this to item number one in the
previous memo.
In addition, copies of the additional materials we discussed were delivered to your office
this morning.
Thank you.
