Ted, Could you please forward me Josh Birks email and also forward him the following questions and ask him to please forward the answers to me and to cc you. I would like to know this information before the P&Z pre -meeting being held on noon Friday, so if for some reason Josh is not available to respond by early tomorrow afternoon, I request that you follow- up to answer these questions. 1-1 would like to confirm the amounts of public assistance being granted to Avago. • 7/19/2011 City Council Resolution 2011-066, Agenda Item #27 appears to approve: $3,2 million in public assistance • 8121/12 City Council Resolution 2012-080, Agenda Item # 37 appears to approve: $5,9 million in public assistance ( $9,1 million cumulative) 10/16/12 City Council Resolution 2012-096 appears to be nearly identical to 8/21/12... is this a clarification or is this another $5,900,000 in public assistance being awarded to Avago? ($ 15,000,000 cumulative ?) 2—In which City Council Review meeting was it disclosed that Avago already had a request for or had already received the building permits for the activities they had professed to require approval of the public funds in order to make a decision to move forward on said improvements in Fort Collins rather than a competing location? Please comment and clarify. What was the situation with the building permits? 3-- The 10/16/12 Council Resolution states: `In the last 7 years, the Economic Health Office (EHO) has brought forth three Business Investment Agreements. The EHO anticipates bringing forth two similar packages — the current Avago Technologies agreement before Council and another one in the near future. Negotiations with company representatives started in early 2012. Avago Technologies reviewed three sites — Fort Collins, CO, Texas, and Singapore. " o In those 7 years, how many of the agreements were with Avago? How many were with other companies? Who were the other companies? What were the respective values of each? 4-- Each of the Avago assistance packages include the statements: "Public Outreach: Negotiations of the planned Avago Technologies expansion and related Business Investment Agreement were conducted confidentially. " o Is this true for all of the negotiations conducted between the City of Fort Collins Economic Health Department and all potential recipients? o Was the public involved in a review or comment of any of these assistance packages prior to when they became public knowledge per the details provided in the agenda for the City Council. o The City Council has multiple work sessions and set of information sent to them to provide a great amount of detail for their decisions. • Was this same information made public prior to the City Council meetings? • Was the same information made public after approval by the City Council, or has the information distributed be primarily the information published in the Council Agenda and follow-on meeting minutes? Your assistance will be greatly appreciated. T.L.
