Parking Lot Stormwater Outflow Drain and Pipe - The City shall install a parking lot drain and outflow pipes under the berm releasing water into the detention pond, consistent with our project's storm drainage plan (i.e. at the location and elevation specified in the plan), with the foregoing all at the City's sole expense. 12. Replacement Trees — The City will replace any trees that the City removes from the property along the perimeter of our property. Any trees that are removed from our property will be replaced around our detention pond. This may or may not be along the perimeter of our property. 13. Erosion and Air Quality Mitigation — In addition to complying with all City requirements, the City shall control blowing dirt by watering down the disturbed soil up to two times per day, Monday through Saturday, as reasonably necessary. 14. Landscaping — City shall repair lawn and irrigation system on both sides of the new parking lot access driveway and elsewhere where existing landscaping is disturbed. 15. Departmental Approvals — Stormwater commits to us that it has received all Current Planning,. Engineering, Natural Resource, Poudre Fire Authority and other necessary approvals for their planned detention pond construction work. Sincerely, Jon Pres J P/ks r provided (half of the existing road for gravel/road base on grade). The City is authorized to proceed in this fashion. The old driveway shall be saw -cut to create an approximate 90-degree turn from the roadway to the new driveway, and all asphalt removed from the premises and disposed of and road base backed up against the cut edge to deter the asphalt from raveling. 4. East Approximate 10 Feet of Parking Lot — Provided paragraph 15 is complied with: To be saw -cut along property line, including asphalt and concrete (curb and gutter). Asphalt shall be removed, road base shall be packed up against the cut asphalt edge to deter asphalt from raveling. All concrete shall be removed and disposed of by City, all of the foregoing at the City's sole expense. We authorize the foregoing. However, if this violates City,parking lot standards, City must obtain a written variance for this parking lot so it may continue to serve existing 8-plex both now and subsequent to its renovation. 5. Electric — The City's Electric Department shall abandon the portion of their electric lines that conflict with City's proposed construction, while maintaining service to the residents of the existing 8-plex and maintaining electric lines and transformers, if any, which are able to serve our proposed development. 6. Water — City's Water Utilities Department shall relocate any water mains that are in conflict with City's proposed construction, while maintaining service to the residents of the existing 8-plex and maintaining water lines which are able to serve our development. 7. Sewer — City will adjust manholes on City property, up or down, to match the new grade established by City construction. These adjustments will have no effect on our project property or on sewer service to either the existing residence or our development. 8. Gas — The City will coordinate with Excel Energy to relocate any gas lines that are in conflict with City's proposed construction while maintaining service to the residents of the existing 8-plex and maintaining lines which can serve our project. 9. Telephone and Cable — City shall coordinate with Qwest and Comcast to assure that City's proposed construction is not in conflict with their lines. 10. Service Interruption to Existing 8-Plex - All of the foregoing abandonment and relocation of utilities shall occur with minimum impact on the apartment/house residents. Ideally, there would be no interruption of any utility service through the apartment/house. However, if interruption is necessary, it will be for not more than two hours. Box 580 700 Wood Street Fort Collins, CO 80522 Re: Manhattan/Letter of Agreement Dear Mark and Jim: Following up my letter of August 19th and our recent meeting, Mark, this is our letter of agreement with the City and authorization for the City to proceed with its stormwater detention pond construction subject to the following terms and requirements and approvals of the below indicated signatories. 1. Tennis Court — The City shall deactivate power -to the tennis court lights, remove tennis court asphalt, light poles and fencing, and all related materials, and dispose of same at the City's sole expense. We authorize the City to proceed with the foregoing. 2. Street Partial Removal — Provided paragraph 15 is complied with: We approve the removal of that portion of Fir Ct. which is on City property provided that that portion of this public right-of-way (not yet vacated) which remains be in compliance with all City statutes and requirements as they relate to access to the existing 8-plex and its renovation. 3. Twenty- Foot Driveway — Provided paragraph 15 is complied with: We authorize the City to put a new 20 ft. driveway in from the access road to the existing parking lot, compaction of sub -grade, road base as necessary, at least 2 inches of asphalt, no curb or gutter or other concrete along edge, align with drive aisle of parking lot, landscape sprinkler line to be relocated under this driveway and new sprinkler heads as necessary installed.
