Re: Manhattan Townhomes Major Amendment

I want to remind you that at my meeting with Steve Olt and Cameron Gloss:
1. We proceeded on the basis of a Major Amendment on your assurance that this
would be an expedited process which could occur in short order without routing.
2. Our position is that as a matter of fact there is considerable evidence that we
have presented in the City's project folder which was before the hearing officer
indicating that this project had 41 units, not 38 units.
3. Furthermore there is evidence in the same City folder indicating that our
application for Minor Amendment and presentation of fee for same was refused
by the City prior to the hearing.
4. Our attorney advised us that rehearing was the most expeditious and correct way
to solve the problem present by the foregoing errors.
5. We acquiesced in the City's preference to do a Major Amendment only because
we were assured that it would be expedited, completed in a very short time table
and would not require routing.
The routing sheet we received from you, a copy (of which is enclosed) notwithstanding,
I trust we are proceeding as indicated above.
