Linda, could you remind me again how it was resolved with leaving the F.A.R. note on the O.D.P. and then
having The Grove P.D.P. comply with the O.D.P. note?

Ted,
It was resolved at P&Z to leave the note on the ODP as originally written. (see below)
P&Z. however, did clarify that if there was ever a conflict between the density required by the LUC and the note
on the ODP, that the Land Use Code would prevail.
City Council did not request any changes to the note which specifies a Floor Area Ratio and how it is to be
calculated, i.e. on a "Parcel" basis. The Appellants alleged that it should be calculated on a Lot or Block basis as
described in the LUC under the definition of FAR.
For the Grove, when the building square footage on Parcel C is divided by the land area on Parcel C the FAR
is .25, well under the .37. This allows for future development on Tract A the only remaining undeveloped
portion of Parcel C.
5. MAXIMUM FLOOR AREA RATIO ( BUILDING SQUARE FOOTAGE DIVIDED BY LAND
AREA SQUARE FOOTAGE) FOR ALL PARCELS NOT TO EXCEED .37.
Please let me know if this is understood because it is very important going forward that everyone agrees how to
calculate the FAR.
