Citizen Request For June 16, 2011 Fort Collins Planning and
Zoning Hearing
To: Planning and Zoning Board Members

Re: Organized Public Presentation Time
On June 16, 2011, the Fort Collins Planning and Zoning Board will review and decide upon the Amended
Centre For Advanced Technology Overall Development Plan and The Grove At Fort Collins Project
Development Plan. This letter, signed by many residents of the surrounding neighborhoods, petitions the
Board to allow that in addition to the customary three minutes allotted per person for public comment, a
30-minute period be allocated for each of the agenda items (ODP and PDP) for organized presentation of
relevant material by a group of concerned citizens. These issues are complex and cannot be
comprehensively or concisely conveyed in three -minute sound bites.
This petition was originally prepared for the May hearing on these matters. That hearing was postponed
to June 16 at the last minute, after the attached signatures had been collected in reference to the earlier
meeting date. We would also like to explain to the P&Z Board that this letter was originally written and
sent to City Council and the City and Deputy City Attorneys. The P&Z Board was not included as a
recipient of the original request because we were unable to locate fcgov.com email addresses for any of
the P&Z Board members.
The following is a summary of the original requests and Mr. Paul Eckman's responses to them:
1) A request that the ODP and PDP items be independent agenda items with separate opportunities
for citizen. This request was granted.
2) The 30-minute presentation request, as stated above, was deferred to the P&Z Board.
3) A request that citizens be given reasonable time for sub -rebuttal following the applicant's
unrestricted opportunity for rebuttal of public comment. Response from Deputy City Attorney was
the following:
"The third request was that citizens be given a reasonable time for surrebuttal following the applicant's opportunity for
rebuttal to public comment. Section 2.2.7(C) of the Land Use Code sets out the procedure for conducting a public
hearing, and though it does allow for public testimony and applicant response to public testimony, it does not allow for
public response to the applicant's response (surrebuttal). Therefore, only if the applicant were to consent to such
surrebuttal, could it be properly allowed. I have been informed by Ms. Liley, attorney for the applicant, that the applicant
will not consent."
We thank you for your consideration of our request. An expedient response is appreciated so we can
prepare our information appropriately ahead of the June 16, 2011 Planning and Zoning meeting.
