Mr. Roy and Mr. Eckman,
I spoke with Steve Olt this morning regarding the letter regarding the questionable validity of the December 8, 2010 PDP
submittal, as we are anxiously awaiting a response from the City in this urgent matter. I wanted to clarify our concern
after speaking with Steve this morning. Certainly, we understand that there is an existing, approved ODP for the Centre
for Advanced Technology that was approved in 2003.
Our concern, however, is the PDP that was submitted on December 8, 2010 did not have a previously approved
or concurrently submitted ODP that fit the street alignment and other characteristics needed to support the December 8,
2010 PDP. That amended ODP was not submitted until March 31 of this year. (As we all know the amended ODP that
was pending when the PDP was submitted on December 8, 2010 was overturned by City Council later in December 2010.)
I am not an attorney, so I apologize if I have not used the proper language or been clear. If additional clarification is
needed, please let me know. I hope this clarifies a misperception that I believe Steve Olt had about our concern.
