Liley Subject: The Grove at Fort Collins PDP/Additional Neighborhood Meeting Paul: Thank you for the meeting yesterday to discuss the City staffs request that Campus Crest consider another neighborhood meeting on the Grove PDP. Since doing so would realistically mean a one -month delay in holding the Planning and Zoning Board hearing (from May to June), a crucial factor for Campus Crest in making that decision is its ability, if the Amended ODP and Grove PDP are approved by the Board, to submit and have reviewed (but not approved) all further required development applications (e.g. FDP and building permit applications) and associated development documents during the pendency of any appeal of the Board decision. Based on Sec. 2-48 of the Municipal Code and Section 2.7.2 of the Land Use Code and the consistent past practice of the City, the response from City staff at the meeting was that such submittals and review were authorized, so long as they were at Campus Crest's risk per the applicable Code provisions. Please let me know by noon today if you disagree with anything in this letter as we need to notify City staff by end of day today about the additional neighborhood meeting and the delay of the Planning and Zoning Board hearing.
