Subject: Responding to your question about the fox den situation/administrative decision process
Good morning Bob,
It was nice to meet you last night. As per our discussion regarding the question of whether the filling in of fox dens
would constitute development, I spoke with Ted Shepard who is our Chief Planner to discuss the administrative
decision process. This is what I gleaned from talking with him:
-City staff has determined that filling the fox dens does constitute development. Without an approved
development plan, as we discussed last night, development cannot occur.
-If the applicant does not agree with this decision, they can request an administrative decision/interpretation (see
Division 1.4, Interpretations of the Code for a discussion on this process) regarding what constitutes development.
Note that, to the best of my knowledge, an official request has not been submitted at this time.
-Once the administrative decision is made, if the applicant still does not agree, they can appeal the administrative
decision (see Division 2.11 of the Land Use Code, Appeal from Administrative Decisions) to the Zoning Board of
Appeals.
