Subject: RE: Status of Variances Appealed at December 21 Council Meeting
Sarah,
This issue is being covered in item #4 under findings of fact and conclusions (page 2) in Resolution 2011-001 and
there's no need for the City Council to take any further action in order to put to rest the two modifications you are
referring to. Campus Crest, the developer, is not concerned with the two modifications which were at issue on
December 21 st as they are no longer needed.
You can get the Agenda Item Summary (Item #9), containing Resolution 2011-001, for City Council's meeting
tonight at www.fcgov.com/cityclerk/agenda5.phhp.

Subject: Status of Variances Appealed at December 21 Council Meeting
Steve,
As you know, I have been trying to get clarification of the status of the two modifications of standards for The
Grove PDP that were appealed at City Council on December 21. (Mr. Roy and I exchanged voicemails for several
days after the hearing up through last Monday, and he then referred me to you last week.)
The Applicant's attorney, Ms Lilley, very near the end of the appeal, stated that the variances were "freestanding"
and good for one year. I believe it is the opinion of City staff that that is not the case as they were submitted as
a part of the PDP (not as freestanding variances). However, when we spoke last week, you said you would
discuss this issue with Mr. Roy of the City Attorney's office, and provide written comfirmation of the status of
these items.
I'm sure you are very busy, but I just wanted to remind you to provide that written confirmation at your earliest
convenience. I was uncertain of the status of the variances at the end of the meeting given Ms. Lilley's
statements, and just want to be very clear of the status of the variances (or modificaitons of standards).
Thanks,
Sarah Burnett
