General Question:
1. Who is paying for the canal move? -- -
Questions for CSURF:
1. Please explain the relocation plan (and how it came to be) for Larimer Canal #2.
2. Why is the canal relocation not part of the ODP?
Questions for the City:
1. Will staff be recommending that the canal move be completed before or concurrent with
building permits are issued for The Grove?
2. - Although City Code allows filling in the floodplain (thus displacing water onto pre-existing
development); has this -been allowed at other locations in the City? If yes, please describe where and
when.
3. Regarding the traffic studies performed:
a Why did the City not require that each of the 4 major intersections within a mile radius of the
development be studied?
b. __Please explain the traffic studies that were required and why.
- c What are the assumptions for numbers of trips generated by the prospective tenants?
d: What are the assumptions for numbers of trips generated by other residents of the City?
e. Please explain LOS (level of service) standards? At what level are each of the major
intersections functioning?
f. Will the developer be paying for any of the cost of Center avenue conversion to an
arterial? How is that calculated?
1. The City has invested millions of dollars in The Gardens on Spring Creek How does The
Grove meet the compatibility requirements of the LUC relative to the Gardens?
2. Is the City giving any development fee rebates, discounts, or any reductions compared to
published development fee rates.
Questions for Campus Crest:
1. Please explain/describe the bike ways through the development.
2. Will the Grove be heated with electricity? And is there any other heat source planned?
3. Could the applicant please address the fact that a traffic counting device was observed by
multiple residents on Center at the proposed intersection of the new Rolland Moore Drive in late
February, but no data from such counts was included in the updated inforrnation submitted this spring?
4. Regarding bicycle traffic:
a How is increased bicycle traffic on Centre Ave going to be dealt with?
b. How is increased bicycle traffic on Spring Creek Trail going to be dealt with?
1. Regarding guest parking:
a How will it be accommodated?
b. Where will overflow parking go?:
c Will there be permit parking?

federally protected class.
2. We understand you intend to market to students. At what point during the leasing process - -_

3. Regarding pets: _
a How many pets will be allowed in the Grove project? One per lease/bedroom? _
b. How will the project deal with animal waste?
c How will the project deal with animal noise? -
d. How will the project protect the wildlife corridor along the Larimer Canal #2 from predatory -

4. How is security going to be maintained in and around the Grove? Does the Grove have a
-- security force .on hand? Does it have other staff on hand trained to deal with criminal activity? What is the

Board members at their work session Friday, June loth, 6 days prior to the public
hearing. I am interested in finding out what policy allowed the neighborhood
questions to go unanswered and is the applicant allowed to submit last minute
information unknown to the neighborhood(s)? It would seem to me that there should
be a kind of grace period when loose ends can be tied up, but new information is
not allowed. If there is no specific policy you can quote, your thoughts are
welcome and appreciated. After the neighborhood meeting on May 23=d was done City
staff, the developers and the applicants agreed on a date of June 8th to have
completed answers to the written questions provided in hard copy at the meeting and
by e-mail on May 241h. City staff had answers to questions directed to the City
completed (with one exception) by June 2°d. The developers and the applicant had
their answers to questions directed to them completed by June 8th, as agreed. Again,
these questions and answers will be distributed to the P&Z Board members at their
work session Friday, June loth
My last question is: Although our questions were not answered are they now of
record and may be brought up at P&Z and at appeal? Your questions have been
completely answered in a timely manner and they are now part of the record so, yes,
they may be brought up at P&Z and at City Council.
As an aside, it seems peculiar to me that you cc: Linda Ripley and Lucia Liley but
not the neighborhood(s). My response Tuesday, June 7th,-was to your e-mail of that
day. I cc'd Linda Ripley and Lucia Liley only because it served as a reminder to
them that staff was still expecting answers to the neighbors written questions by
June 8th as agreed upon. Now that the questions & answers are complete the neighbors
will be notified.

Please see my answers to your questions (below, in red).
Also, attached to this e-mail are:
• The completed answers to the neighbors written questions. On pages 1 & 2
CSURF's answer to Question 3 references two (2) letters, one from City
Planning Staff and one from the Army Corp of Engineers. Both of these letters
are also attached.
• The completed Questions & Answers document from the scribed notes taken at
the neighborhood meeting on May 23,d.
These documents will be provided to the Planning & Zoning Board members at their
work session tomorrow, Friday, June loth. Also, I will be e-mailing this information
to the neighbors by the end of the day tomorrow.

Hi Steve,
Thanks for your response about the neighborhood meeting questions.
Please do not take this email personally. I find there is no progress made by
placing blame or pointing fingers.
What I am interested in are: policies, procedures, regulations, whatever they are
called by the city. I assume that there is a date/time certain that information is
provided to the P&Z packet. Section 2.2.2(C) of the Land Use Code states: "A
written summary shall be prepared by the Director. The written summary shall be
included in the staff report provided to the decision maker at the time of the
public hearing to consider the proposed development." The completed answers to the
neighbors written questions (attached) will be distributed to the Planning & Zoning
