Subject: Spring Creek floodway regulations
Hi Steve,
The Grove ODP is within the Spring Creek FEMA regulatory floodway and floodplain and is subject to Chapter 10
of City Code.
1) Residential is not allowed in the floodway
2) Mixed use is not allowed in the floodway
3) Nonresidential is allowed in the floodway with the following restrictions and must be preceded by a
floodplain use permit.
a. Structure, development, obstruction or activity must be shown by appropriate floodplain modeling
to result in no increase in base flood elevations or change in floodway or flood fringe boundaries
except on the applicant's contiguous property or on property for which the applicant has obtained
and recorded easements.
b. Structures must be elevated to at or above the regulatory flood protection elevation.
c. Flood proofing may be substituted for elevation.
d. No new basements are allowed.
e. Mobile buildings are not allowed.
4) Fencing, detention ponds, paths, trails, walkways, fill, outdoor storage, parking areas, vegetation, and
other non-structural activities may occur in the floodway if preceded by a floodplain use permit.
5) All proposed activities in the floodway must be permitted with a no rise certification prepared by a
registered professional engineer licensed in the state of Colorado, submitted with appropriate technical
evidence to support the certification.
I hope this is helpful in understanding what is allowed in the Spring Creek floodway.

Would it be easier for you to just reference "all requirements of Chapter 10 of the FC Municipal
Code" to make your staff report easier to write?
