This meeting was requested by Lucia Liley and the developers of The Grove (Campus
Crest) to discuss two issues:
Concerns about the completion of the FDP process. There is an approved PDP,
but there is continuing neighborhood involvement on a variety of old and new
issues, and concern that the project approval is in jeopardy or that the final review
will be delayed. Lucia asked that we send copies of Sarah Burnett's
correspondence (done). We discussed several concerns about the process and the
developers' attempt to reach out to the neighbors.
2. Timing of final approval and removal of fox dens. Final plans are under review
by the staff. This phase includes drafting of the Development Agreement, review
for compliance with all conditions, etc. No "development" (disturbance of the
property) can occur before this phase is finalized, for a lot of very good reasons.
The developers are concerned about meeting their construction timeline. Work on
the ditch, which must occur during the winter when the water is not running, will
begin as soon as the final plans are approved. At least a few fox dens are near
wetlands, and they will be affected by the ditch work. The only time you can
remove or block fox dens is late fall, before foxes have kits (December 1 or so).
Campus Crest would like to find a way to block the fox dens before it's too late,
even though the final plans are not approved yet.
My initial reaction, as well as Paul Eckman's, was that it was not possible. We
recently addressed a similar issue with the Capstone project, whose developers
wanted to start removing trees before they had all their easements. The planners
have discussed this before, and I am checking with the environmental planner, to
see if there is a legal, legitimate way to address this. The neighbors were
reportedly not concerned about the project's impacts on the fox dens, possibly
because there has been such a proliferation of them. We are meeting on Monday
morning to consider any options.
We also discussed the City's changes to the development review process, and the
proposed changes to the appeal hearing procedures. (They think that 120 days is too
long, and will be a breaking point for some projects).
