The online edition of the Coloradoan does not contaiin the section of this story that appeared on
page A2 of the print edition.
In that section, Steve Olt, seinor planner for the City of Fort Collins says that the appeals are very
extensive and will require a significant amount of time to respond to the allegations.
WHAT? The city is out of it now. According to policies and laws, Current Planning has nothing to
do with this from here forward, other than presenting materials submitted by the parties in the
appeal to the decision makers.
Speaking with Mr. Steve Olt this morning, he could not tell me under which policy or procedure
he had been directed to prepare a response to the 'allegations' contained in the appeal. That is
because there is none. His response is not necessary, asked for or in any way material to the
appeals process.
Steve Olt's assertion that Current Planning has been directed by Council, the arbiters of the
appeal, to prepare a response is erroneous. When has Council acted, by virtue of their authority
as granted by Charter or Code, to direct staff to prepare a response? It hasn't. This is simply
more of City Staff doing whatever it can to assist the applicant.
It is also one more betrayal of staff s unfamiliarity with the code and policies they are paid to
administer. I say one more, because the appeal itself contains numerous citations documenting
the same unfamiliarity.
It is also one more indication that the affairs of the City of Fort Collins are inclined to to drift
toward illegalities to satisfy the 'direction' of the executive administration.
If anyone in Current Planning had it together, this entire controversy would never have
happened, someone would be building new housing on the site and everyone would be happy
as clams. Couldn't possibly happen that way, of course. Everyone was to busy sustaining,
connecting and I forget what the other action word was to worry about building a decent city.

The Grove is a terrible idea. I've spoken with someone at Rams Village (a similar development)
and they currently have 30%vacancy for next year. Obviously the demand for living in these
types of places isn't there.

This is too large of a development for the area. Also, students tell me it is not hard to find
housing close to campus. It's not needed.
STW, the HOA is Windtrail. I think this is an important story. The Coloradoan should do over
since it's half written and incorrect.

Seems like most people want this project to go away. I couldn't agree more. Don't go away mad,
just go away.

Mr. Olt,
I'm really looking forward to your reply. I am really interested in learning how City Council has
directed staff to prepare responses to appeals to P&Z actions in general, or the two appeals we spoke of
in particular.
Please take a moment to review my comment on your statement in the Coloradoan this morning.

I am reminded of Mayor pro tern Ohlson's recent comment regarding who the customers of Current

Steve —
That's fine. I think the important thing is to work w/Karen and Bruce Hendee to prepare a response that will go
out from Darin and to do that as expeditiously as possible. Thanks again.

Diane,
I took the call from Mr. Sutherland this morning without realizing who it was or what I was getting into. That
certainly will not happen again. For some reason he thinks that, as he said in his comment to the Coloradoan,
Current Planning's work is done as the City prepares for Council's deliberations of the 2 appeals.
Thank you and Darin for your help with this.

Sure. I assume you mean by the "context" of our prior dealings w/Mr. Sutherland and that communication is to
come through you/CMO.
