KNOW ALL MEN BY THESE PRESENTS: That the undersigned Cowan Enterprises, Inc., a
Colorado corporation, being the owner of certain real property in Larimer County, Colorado legally described at
Reception No%, op1fi in the Larimer County Records, in consideration of Ten Dollars ($10.00) in hand paid,
receipt of which is hereby acknowledged, and other good and valuable consideration, does hereby dedicate,
transfer, and convey to the City of Fort Collins, Colorado, a Municipal Corporation, for public use forever a
permanent easement for public utilities including, but not limited to, sanitary sewer lines in the City of Fort
Collins, County of Larimer, State of Colorado, more particularly described on Exhibit "A" attached hereto and by
this reference made a part hereof.
It is understood by the undersigned that, by acceptance of this dedication, the City of Fort Collins will not

OF THE PLANNING AND ZONING BOARD
OF THE CITY OF FORT COLLINS ACCEPTING THE
DEDICATION OF A UTILITY EASEMENT AT 400 HICKORY STREET
WHEREAS, Section 2-353 (4) of the Code of the City of Fort Collins authorizes the
Planning and Zoning Board to accept dedication of certain easements by resolution or by
approval of replats containing notation of such dedication; and
WHEREAS, the Owner has presented to the City a deed of dedication for a utility
easement located on the real property known as 400 Hickory.Street, which easement is
more particularly described below; and
WHEREAS, the dedication has been reviewed and approved by the pertinent City
Departments, which departments report no objections to the dedication.
NOW, THEREFORE, be it resolved by the Planning and Zoning Board of the City of
Fort Collins, that the "Utility Easement and Agreement" conveying a utility easement to the
City at 400 Hickory Street, which deed is attached hereto and incorporated herein by this
reference, is hereby accepted.
Passed and adopted at a regular meeting of the Planning and Zoning Board of the
City of Fort Collins held this 19"' day of October A.D. 2006.

PROJECT DESCRIPTION:
Request to accept a utility easement at 400 Hickory Street, Hickory Village Mobile
Home Park, more particularly described on Exhibit "A".
RECOMMENDATION: Staff recommends approval of Resolution PZ06-12
EXECUTIVE SUMMARY:
A utility easement is being dedicated along the northwesterly portion of the Hickory
Village Mobile Home Park site for purposes of connecting sanitary sewer services to the
proposed Arcadia development. The proposed development will connect with an
existing sanitary sewer main line located on the mobile home park property.
