2. If for some reason you don't wish to do it by the note on the plat we can vacate it by separate document.
We would need a legal and sketch for each easement group and then would route the request. The actual
vacation resolution is an administrative process to approve the vacation. The processing fee for doing this is
$400 for each easement plus the recording fees.
Assuming you wish to vacate the easement by a note on the plat - just have the note added so it is there for all
the utilities to see with the final review submittal.

Dear Sheri,
Another matter on my list of development requirements is that the City's
drainage easement, currently located along the north boundary of Block 6
needs to be vacated. You may recall that Rich Richter had previously agreed
that such easement was no longer needed by the City and could be vacated.
The planning for the Sunterrace project, more specifically the northwest corner
of the new detention pond for Sunterrace, encroaches into the drainage
easement. Can this easement vacation occur at the same time as the ROW
matter?

Ted, I would like to eliminate the need to do a seperate vacation of the drainage easement on Tract F on Block 2
of Old Town North by adding such a note to the current Sunterrace Replat. Can you please review the Sheri's
comments below and let me know if that is feasible at this time?

As we discussed on the phone - The note can only apply to and vacate easements on tracts included within the
replat boundaries. Tract F was not a part of the replat that went to hearing.
I don't know how easy it would be to expand the area of the replat since the project went to hearing. If the
boundary was expanded there would be additional TDRF for the added area.

Thank you for this information, Sheri. Shear and RJL are making such note on the current Sunterrace replat
(your "best and easiest way"). I would like to confirm that we may also notate removal of such easement on
"Tract P, on the Sunterrace plat, to wrap this matter up.

There are a couple of ways this can occur.
1. The best and easiest way is to vacate the easements by a note on the plat. A note similar to this one can be
placed on the plat. Your surveyor can adjust the language as he sees fit.
All easements shown on the plat of xxx that are affected by this replat are hereby vacated and dedicated as
shown hereon.
