Linda and Damon,
I have reviewed the copy of the Amended CSURF Centre for Advanced Technology ODP
(dated 06/01/2011) that you submitted today and find it to be, for the most part, consistent with
the original Amended ODP submitted 03/30/2011 for review and the ODP that was presented to
the Planning & Zoning Board for their June 16, 2011 public hearing deliberation and ultimate
approval. However, the Board did, in their motion, place a requirement that two (2) notes
pertaining to Secondary Uses and Floor Area Ratios as shown on the CSURF Centre for
Advanced Technology ODP approved on February 20, 2003 be included on the Amended ODP.
Board member Lingle's motion reads as such:
To approve the Amended CSURF Center for Advanced Technology Overall Development
Plan, #MJA110001, based on the Findings of Facts and Conclusions beginning on page 11 of the
staff report with the exception of the two ODP notes concerning secondary uses and the FAR
(Floor Area Ratio). They should remain as shown as they currently are on the existing ODP.
This motion was seconded and approved by the Board with a vote of 5 —1. Please see the
attached copy of the minutes from the June 16, 2011 P&Z Board hearing. The notes referred to
by the Board are GENERAL NOTES #3 and #5 on the ODP approved 02/20/2003 (please see
attached highlighted portions of that ODP). City Council upheld the Board's decision at their
meeting on September 6, 2011 where they deliberated the appeal of the Board's approval of the
Amended ODP.
The aforementioned notes regarding Secondary Uses and Floor Area Ratios currently are not on
the Amended ODP that you have submitted for review and approval. Therefore, staff is unable
to approve and record this document at this time and final approval of The Grove at Fort Collins
development plans is contingent on approval of the Amended ODP.
