Dear Mr. Brandy,
An application has been received by the City of Fort Collins Development Review Center that
requests a change -of -use for the property at 516 Deines Court. The request is for an Extra
Occupancy Rental House for 5 tenants. The property is in the LMN, Low Density Mixed -Use
Neighborhood District and the requested use is permitted in that District, subject to an
Administrative (Type 1) review and public hearing. Any final decision will be made by a City -
appointed Hearing Officer. You will be notified by letter of the public hearing and the letter
must be mailed at least 14 days prior to the hearing.
Being as the requested use is permitted, City staff will be reviewing the application by applying
applicable Land Use Code criteria. Staff will primarily be looking at the landscaping
requirements, parking requirements and engineering requirements as set forth in Article 3 —
General Development Standards of the code. Another critical section of the code that will be
applied is Section 3.5.1 — Building and Project Compatibility. This section states that "the
purpose of this Section is to ensure that the physical and operational characteristics of proposed
buildings and uses are compatible when considered within the context of the surrounding area".
The 516 Deines Court Extra Occupancy Rental House, Project Development Plan -
#PDP120005 was submitted to the City on February 27, 2012. It will go through an initial 3-
week round of staff review. A staff review meeting is scheduled for Wednesday morning, March
21, 2012. At this meeting City staff will meet with the applicant to discuss the documentation
provided for review and it will be determined if the required public hearing can be scheduled for
a Hearing Officer to make a decision based on a staff recommendation. The Hearing Officer's
decision is appealable to City Council and any appeal must be filed within 14 days of the date of
the decision. Grounds for an appeal are set forth in, and must be supported by, the Land Use
Code.
We thank you for expressing your concerns related to potential impacts of the proposed extra
occupancy rental house in your neighborhood. Your comments will be considered in the staff
review and will be forwarded to the Hearing Officer at such time the public hearing is scheduled.
